About introduction of amendments to the Copyright law and the related rights No. 230/2022

This law partially shifts the Directive 2012/28/EU of the European parliament and Council of October 25, 2012 about a certain permitted use of the works which are not determined by the subject of copyright (orphan works) (the text extends to the EEA) published in the Official magazine of the European Union by L 299/5 of October 27, 2012.
Art. I. - In the Copyright law and the related rights No. 230/2022 (Official monitor of the Republic of Moldova, 2022, Art. No. 278-282, 578), to make the following changes:
1. To add harmonization formula after the words "and also partially shifts:" with the subparagraph of the following content:
"-The directive 2012/28/EU of the European parliament and Council of October 25, 2012 about a certain permitted use of the works which are not determined by the subject of copyright (orphan works) (the text extends to the EEA) published in the Official magazine of the European Union by L 299/5 of October 27, 2012;".
2. Add Article 1 with part (4) the following content:
"(4) the Provisions of this law concerning orphan works do not affect the situations relating to patents for inventions, trademarks, industrial drawings and models, useful models, topography of semiconductor products, typographical fonts, the caused access, access of services of broadcasting or television to cable relaying, protection of national property, requirements to system of obligatory copy, restrictive practicians and unfair competition, trade secret, safety, confidentiality, personal data protection and observance of mystery of private life, access to public information, agreements, freedom of press and freedom of expression in mass media.".
3. To add article 3 after the concept "joint work" with concept of the following content:
