About modification and amendments in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 2, 2014 No. 862 "About approval of Rules of state registration and accounting of separate types of vehicles on vehicle identification number, training of drivers of motorized vehicles, acceptance of examinations and issue of car driver licenses"

I ORDER:

1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 2, 2014 No. 862 "About approval of Rules of state registration and accounting of separate types of vehicles on vehicle identification number, training of drivers of motorized vehicles, acceptance of examinations and issue of car driver licenses" (registered in the Register of state registration of regulatory legal acts for No. 10056) the following changes and amendments:

in Rules of training of drivers of the motorized vehicles approved by the specified order:

exclude Item 1-1;

in Item 2 to exclude paragraph two;

add with Item 5-1 of the following content:

"5-1. Accounting of the educational organizations and registration of educational groups are performed by means of information system of authorized body on traffic safety (further – IS "Driving school").

The notification on the beginning of activities which arrived in authorized body on safety of traffic from the educational organization is the basis for registration and accounting of the educational organization in IS "Driving school".

Registration of the educational organization in IS "Driving school" is performed in day of receipt of the adequate notice (in case of receipt of the notification after 18:00 working hours, in days off and holidays registration of the educational organization in IS "Driving school" is performed the next working afternoon).

After registration of the educational organization in IS "Driving school", the authorized body on safety of traffic within three working days provides to the educational organization the authorized access to IS "Driving school" for registration of educational groups.

Registration of educational groups in IS "Driving school" is performed based on the order of the educational organization within five working days from the date of the publication of the relevant order.

IS "Driving school" provides formatno-logical control which does not allow:

1) registration of educational groups numbering more than thirty people;

2) inclusion of trainees in earlier registered educational groups;

3) receipt of the certificate on the termination of training courses in case of not passing by the trainee of full course of training according to standard programs of training of transport drivers, and also in case of receipt of negative estimates by results of final assessment in the educational organization.

Conducting registration of educational groups with use of information system of professional associations on the training of transport drivers connected by means of integration service to IS "Driving school" is allowed.";

"7. Offices (classes) for training of drivers are equipped according to the minimum list of the educational equipment of office (class) or with use of information technologies for training of drivers of the corresponding category of MTS according to appendix 2 to these rules.";

"8. The main forms of education is theoretical and practical training.

Theoretical classes in each subject are planned no more than two hours a day, practical - six hours.

During the day with one trainee on driving of the car it is allowed to fulfill:

1) on the autoexercise machine - no more than one hour;

2) on the educational car no more than two hours, except for exercises "Driving in column", and also the exercises connected with transportation of goods which are fulfilled within four hours.";

in Item 10 to state paragraph two in the following edition:

"Practical training on the device and maintenance of cars and first aid by the victim in case of road accident, is carried out after studying of the corresponding theoretical material on one or several subjects.";

in Regulations of Admission of examinations and issues of the car driver licenses approved by the specified order:

"1. These rules of acceptance of examinations and issue of car driver licenses (further - Rules) establish procedure for acceptance of examinations, issues to citizens of the Republic of Kazakhstan, to foreign citizens and stateless persons of car driver licenses on the right of control of vehicles of different categories and the subcategories entering them, stipulated in Item 1 article 73 of the Law of the Republic of Kazakhstan "About traffic" (further – the Road traffic act).";

"11-1. For passing theoretical or practical examinations candidates for drivers submit the application through the portal of the electronic government (further – PEP), objects of informatization (information systems of banks of the second level) (further – objects of informatization), or by means of the address to the operator of services.

In case of the address the candidate for drivers undergoes identification by reconciliation through PEP, objects of informatization biometric these persons with the data containing in the state information systems. Later in "personal account" of the candidate for drivers the status about acceptance of request for rendering the state service is reflected.

In case of the address to the operator of services the candidate for drivers shows the identity document, or the electronic document from service of digital documents (further – the electronic document).

The employee of operator of services verifies the identity document, or the electronic document with the data containing in the state information systems (for identification).

In cases of negative result of identification of the identity of the candidate for drivers just before holding examination, including by biometric reconciliation, the statement of not passing of identification of the personality in the form determined by State corporation with entering of the corresponding data into information system is drawn up.

To the candidate for drivers refuses in the subsequent passing theoretical or practical examinations based on the act of not passing of identification of the personality by it within 6 months from the date of execution of the specified act.

11-2. The candidate for drivers chooses the place, day and time of passing theoretical or practical examinations, proceeding from availability of empty seats for passing theoretical or practical examinations no later than one working day about day of its carrying out and taking into account the terms established in this Item.

Repeated examination, both theoretical, and practical, is appointed to the next working day from the date of carrying out previous.

In case of two negative results of passing theoretical examination, each subsequent theoretical examination in case of negative result is held not earlier than in one month.

In case of two negative results of delivery of practice examination, the subsequent practice examination is carried out not earlier than in one month.

In case of three negative results of delivery of practice examination results of passing theoretical examination are cancelled (the number of attempts is nullified). The candidate for drivers is allowed to passing theoretical examination not earlier than in two months.
