About introduction of amendments to the Law on forming of real estate units No. 354/2004
The Parliament adopts this organic law.
Art. I. - In the Law on forming of real estate units No. 354/2004 (Official monitor of the Republic of Moldova, 2004, Art. No. 233-236, 999), with subsequent changes, to make the following changes:
1. Parts (2) and (Article 1 to state 4) in the following edition:
"(2) the Subject of this law are forming of real estate units and their components as subjects to registration in the real estate register by allocation of part of object, separation, consolidation, combination or rebreakdown of the real estate units registered in the real estate register, and registration of the created real estate units.";
"(4) the Legal relationship connected with differentiation of public property are regulated by the Law on differentiation of public property No. 29/2018 and the Regulations on procedure for differentiation of real estate units of public property approved by the Order of the Government No. 63/2019.".
2. Part (Article 7 to state 1) in the following edition:
"(1) When forming real estate units the following main conditions shall be complied:
a) in case of forming of the parcels of land occupied with structures or the parcels of land on which construction of structures is supposed their form and the sizes shall correspond established in regulations in the field of town planning and improvement of the territory legal, technical and architectural town-planning to the mode;
b) the created real estate unit shall be provided access with expensive/separate pass or possibility of establishment of the servitude for ensuring access to it according to documentation on town planning and improvement of the territory approved in accordance with the established procedure, regulations and normative and technical documents in construction, regulations on industrial safety and protection against floods, and also environmental and sanitary standards;
c) in case of crossing of borders of the created site with borders of other administrative and territorial units real estate units shall be created as separate objects in each administrative and territorial unit;
