About modification of some regulations (testing for drugs)
The Parliament adopts this organic law.
Art. I. - In the Law on control and the prevention of abuse of alcohol, illegal consumption of drugs and other psychotropic substances No. 713/2001 (Official monitor of the Republic of Moldova, 2002, Art. No. 36-38, 208), with subsequent changes, to make the following changes:
1. Add Article 1 with concept of the following content:
"conducting testing for drugs - performed with use of the technical means of action of the police officer or other authorized person approved and undergone metrological checking, directed to identification of consumption of narcotic, psychotropic substances, ethnobotanical means and their analogs.".
2. In Article 7:
part (to state 7) in the following edition:
"(7) For factual determination of vehicle control by the driver in alcohol intoxication or under the influence of narcotic, psychotropic substances, ethnobotanical means and their analogs the police officer or other authorized person holds testing for alcohol and/or for drugs.";
in part (8) words of "the alcohol test" shall be replaced with words "testings for alcohol and/or for drugs".
3. In part (shall be replaced with words 2-6) Articles 17 of the word of "the alcohol test" "testings for alcohol, testings for drugs".
Art. II. - In part (3) article 264-1 of the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes, words "the alcohol test," shall be replaced with words "testings for alcohol and/or testings for drugs,".
Art. III. - In part (2) Article 182-1 of the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes, after the words "testing for alcohol" to add with the words "testing for drugs".
