About modification of the Law of rights and responsibility of the patient No. 263/2005

The Parliament adopts this organic law.

Single Article. - In the Law of rights and responsibility of the patient No. 263/2005 (Official monitor of the Republic of Moldova, 2005, Art. No. 176-181, 867), with subsequent changes, to make the following changes:

1. In Article 1:

in part (1) word "in the field of health care", shall be replaced with words "in health care system,";

in part (2):

state the concept "patient (consumer of medical services)" of the following edition:

"the patient (the receiver of medical services) - the physical person which is needing medical services, who addressed for them or using them, irrespective of state of his health, or voluntarily participating as the subject in biomedical researches;";

in the concept "medical services" of the word "and recovery" to exclude;

in the concept "consent of the patient to medical intervention" of the word of "the patient or his legal representative (close relative)" shall be replaced with words "the patient, his legal representative or the close relative";

state the concept "medical mistake" of the following edition:

"medical mistake - the professional mistake made when implementing the medical or medico-pharmaceutical act as a result of which harm is done to the patient, attracting the civil responsibility of medical personnel and supplier of medical, sanitary and pharmaceutical products, services;";

add Article with concept of the following content:

"the personalized treatment - application of the therapeutic plan adapted for features of molecular genotype of the patient with use of the advanced innovative technologies;".

2. In Article 2:

in Item е) shall be replaced with words words of "(close relative)" "or the close relative";

add Article with Item h) the following content:

"h) cooperation of the patient and health worker in the course of rendering medical services.".
