About modification of the Section II "Final provisions" of the Law of Ukraine "About the basic principles of forced withdrawal in Ukraine of objects of the property right of the Russian Federation and its residents" concerning refining of questions of payment by the state companies of part of net profit

The Verkhovna Rada of Ukraine decides:

1. Item 3 of the Section II "Final provisions" of the Law of Ukraine "About the basic principles of forced withdrawal in Ukraine of objects of the property right of the Russian Federation and its residents" of March 3, 2022 No. 2116-IX; with the changes made by the Law of Ukraine of December 1, 2022 No. 2792-IX to state in the following edition:

"3. Determine that the net profit of the state companies, economic societies in which authorized capital more than 50 percent of shares (shares) belong to the state from which dividends or part of net profit are calculated and paid decreases by the amount of the income or increases by expense amount, the objects of the property right of the Russian Federation and its residents which arose in the accounting period in connection with obtaining according to this Law, and/or decreases by the amount of debt on which right to claim is compulsorily withdrawn as object of the property right of the Russian Federation and its residents according to this Law and which is considered extinguished from the date of entry into force of the law on approval of the Presidential decree of Ukraine about enforcement of the decision of the National Security and Defense Council of Ukraine on forced withdrawal of the corresponding objects of the property right of the Russian Federation and its residents. Action of the specified Item is applied to the accounting periods, since day of entry into force of the law on approval of the Presidential decree of Ukraine about enforcement of the decision of the National Security and Defense Council of Ukraine on forced withdrawal of the corresponding objects of the property right of the Russian Federation and its residents. For underpay of part of net profit or dividends which are payable in connection with reflection of the specified transactions in the reporting penalties are not applied".

2. This Law becomes effective from the date of, its publication following behind day.
