About introduction of amendments to the Law of the Kyrgyz Republic "About cooperatives"

Article 1.

Bring in the Law of the Kyrgyz Republic "About cooperatives" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2004, No. 10, the Art. 436) the following changes:

1) in Article 1:

a) state Items 2-1 and 2-2 in the following edition:

"2-1. Housing and operational cooperative - the voluntary consolidation of owners of residential and non-residential premises on the basis of membership for management of common property of the apartment house based on combining of their property shares having money value.

2-2. Housing, housing and operational or housing cooperative - the voluntary merging of physical persons on the basis of membership for construction of the apartment house or housing estate created according to the procedure, established by the legislation of the Kyrgyz Republic.";

b) add with Item 2-3 of the following content:

"2-3. Housing and accumulative cooperative of mutual assistance - voluntary merging of physical persons on the basis of membership for requirements satisfaction of members of cooperative in premises by merging of cooperative of shares by members.";

c) state Item 11 in the following edition:

"11. Fund for emergency situations - the fund intended for covering of the expenses connected with special circumstances namely debts and the credits of cooperative. Cooperatives shall create such fund and determine its amount, property share and procedure for use in the charter.";

d) add Article with Item 15 of the following content:

"15. Authorized body on control of activities of housing cooperatives and housing and accumulative cooperatives of mutual assistance - the body exercising control of activities of housing cooperatives and housing and accumulative cooperatives of mutual assistance. Authorized body, and also its powers are determined by the Cabinet of Ministers of the Kyrgyz Republic.";
