About modification and amendments in the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of June 1, 2022 No. 308 "About approval of Rules of provision of the measures of the state stimulation of the industry directed to performance improvement of work of subjects of industrial and innovative activities"

I ORDER:

1. Bring in the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of June 1, 2022 No. 308 "About approval of Rules of provision of the measures of the state stimulation of the industry directed to performance improvement of work of subjects of industrial and innovative activities" (it is registered in the Register of state registration of regulatory legal acts at No. 28320) the following changes and amendments:

in Rules of provision of the measures of the state stimulation of the industry directed to performance improvement of work of the subjects of industrial and innovative activities approved by the specified order:

state Item 5 in the following edition:

"5. In these rules the following terms and determinations are used:

1) advancing – provision of money for future expenses (costs) for increase in employee competence abroad;

2) information system – the organizational arranged set of the information and communication technologies, service personnel and technical documentation realizing certain technological actions by means of information exchange and intended for the solution of specific functional objectives;

3) six sigma (Six Sigma) – element of economical production, the management concept production providing need of improvement of quality of exits of each of processes, minimization of defects and statistical variations in operating activiies (further – Six Sigma);

4) installation of equipment – assembly, installation in project provision and permanent fixture of the equipment with accession to it of control facilities and automatic equipment, and also the communications providing raw material feed, waters, couple, energies and waste disposal of production;

5) equipment supervision of erection – the technical guidance installation of equipment performed of manufacturer of this equipment or the contractor – the supplier of the equipment;

6) general care of the equipment (Total productive maintenance (TPM) – element of economical production, the concept of management of production equipment aimed at increase in efficiency of maintenance (further – TPM);

7) commissioning of the equipment – complex of the works performed during preparation and carrying out individual testing and complex approbation of the equipment;

8) maintenance of the equipment – complex of actions or action for maintenance of operating state and/or serviceable condition of the equipment, in case of proper use, to storage and/or transportation without their conclusion in repair;

9) the Industry 4.0 – the production organization providing integration of physical objects, processes and information and communication technologies in case of which monitoring of physical processes is in real time carried out operational decisions are made, and also interaction of technologies among themselves and people is performed;

10) technology (elements) of the Industry 4.0 – the additive technologies or 3D seal, collaborative robots, the self-optimized equipment, technologies of quality assurance (sensors and sensors), pilotless vehicles, the automated internal logistics, cloud computing, digital modeling of industrial facilities, digital "doubles" of factories, virtual input of the equipment in operation, digital and virtual engineering, integration of management systems production processes (Manufacturing Execution System, MES), augmented reality, virtual reality, warehouse control systems, cyber security, predictive maintenance, intellectual planning and production control, the industrial Internet, monitoring of condition of systems;

11) kaizen (Kaizen) – element of economical production which is focused on continual process improvement of production, development, auxiliary business processes and managements, and also all aspects of life (further – Kaizen);

12) kanban (Kanban) – element of economical production, the system of production organization and supply allowing to realize the principle "just in time" (further – Kanban);

13) counter obligations – the cross liabilities of the subject of industrial and innovative activities and the state accepted by provision of measures of the state stimulation of the industry according to the Law of the Republic of Kazakhstan "About industrial policy";

14) the contractor – the individual entrepreneur or the legal entity rendering the services (performing works) to the applicant or the involved foreign employee, within these rules;

15) subjects of industrial and innovative activities – physical and (or) legal entities, the particular partnerships realizing the industrial and innovative projects or performing activities for promotion of domestic goods, works and services of processing industry on internal and (or) the foreign markets;

16) authorized body in the field of the state stimulation of the industry (further – authorized body) – the central executive body performing management in the field of the industry and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination and participation in realization of the state stimulation of the industry;

17) digital transformation of the industry – the implementation of digital technologies in business processes of the companies attracting considerable changes of business model of the company;

18) the applicant – the subject of industrial and innovative activities who submitted the application for provision of measures of the state stimulation of the industry, directed to work performance improvement;

19) training – professional training and/or retraining and/or advanced training at the foreign plant or the organization;

20) prototype – the product sample made on again developed worker of documentation for check by testing of compliance to its set technical requirements for the purpose of decision making about possibility of statement on production and/or proper uses;

21) national institute – the national institute of development in the field of industry development rendering services in provision of measures of the state stimulation of the industry (joint-stock company "The Kazakhstan center of the industry and export of "QazIndustry");

22) economical production – the management concept production enterprise based on permanent aspiration to elimination of all types of losses, including elements: Kaizen, TPM, Six Sigma, 5 S, Kanban;

23) electronic document package – the documents which are completely reproducing the type and information (data) of the authentic document in electronic and digital form certified by the digital signature the first head or person fulfilling its duties (in the presence of the supporting document about fulfillment of duties of the first head), or the individual entrepreneur or person authorized by them (in the presence of the power of attorney) or physical person;

24) the electronic request – the request in electronic and digital form certified by the digital signature the first head or person fulfilling its duties (in the presence of the supporting document about fulfillment of duties of the first head), or the individual entrepreneur or person authorized by them (in the presence of the power of attorney) or physical person;

25) the digital signature – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

26) energy audit (energy audit) – collection, processing and data analysis about use of energy resources for the purpose of assessment of opportunity and energy saving potential and preparation of the conclusion;

27) energy efficient technologies – technologies which are directed to effective (rational) use of energy resources. Use of smaller amount of energy for ensuring the same level of energy providing buildings or engineering procedures on production;

28) 5S – element of economical production, system of the organization and rationalization of workplace (working space) (further – 5S).";

add with Item 6-1 of the following content:

"6-1. The authorized body within three working days from approval date or change of Rules informs national institute, the operator of information and communication infrastructure of "the electronic government", and also Single contact center, on the made changes and (or) additions in these rules.";

1) of Item 12 to state the subitem in the following edition:

"1) increase in employee competence on:

professional training and/or retraining and/or advanced training of engineering personnel, production personnel, including top managers, in the territory of the Republic of Kazakhstan and abroad, concerning performance improvement of work and/or implementation of technologies (elements) of the Industry 4.0. The head of the legal entity or the member of executive body or the head of the structural unit on production and/or promotion made products/services, except for financial (accounts department), administrative, legal division treat top managers;

duration in case of professional training and/or retraining and/or advanced training of engineering personnel, production personnel, including top managers, in the territory of the Republic of Kazakhstan constitutes no more than 3 (three) months;

duration in case of professional training and/or retraining and/or advanced training of engineering personnel, production personnel, including top managers, abroad constitutes no more than 3 (three) months in case of compensation of 40% of the incured costs;

duration in case of professional training and/or retraining and/or advanced training of engineering personnel, production personnel abroad constitutes no more than 6 (six) months when advancing 50% of transportation expenses to the place of sending and back to the place of permanent job once and 50% of expenses on accommodation;
