About modification in Criminal and Criminal procedural codes of Ukraine concerning criminalization of smuggling of goods
The Verkhovna Rada of Ukraine decides:
1. Make changes to such legal acts of Ukraine:
1) in the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):
in Article 201:
state the name in the following edition:
"Article 201. Smuggling of cultural values and weapon";
the second to state part in the following edition:
"2. The same action made by previous concert by group of persons or person previously convicted for smuggling or the official with use of official position, -
it is punished by imprisonment for a period of five up to twelve years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years and with confiscation of property";
add with the note of the following content:
"Note. 1. In Articles 201, 201-1, 201-3, 201-4, 305 of this Code through customs border of Ukraine of objects of smuggling out of customs control it is necessary to understand intentional movement of objects of smuggling out of the location of customs authority as movement or out of the working hours established for it and without accomplishment of customs formalities or movement of objects of smuggling with illegal release from customs control.
