About modification of some regulations (implementation of the mechanism of environmental impact assessment and strategic ecological assessment)

The Parliament adopts this organic law.

Art. I. – In the Law on environmental protection No. 1515/1993 (Official monitor of the Republic of Moldova, 1993, No. 10, of the Art. 283), with subsequent changes, to make the following changes:

1. Item d) Article 3 to state in the following edition:

"d) planning, design, placement and commissioning of subjects to social and economic appointment, implementation of program documents, plans and the planned activities which can make impact on the environment and health of the population of the Republic of Moldova or other states are allowed only under condition:

– carrying out assessment procedure of impact on the environment and/or on circumstances of assessment of biodiversity of the planned activities provided in appendices 1 and 2 to the Law on environmental impact assessment No. 86/2014;

– carrying out assessment procedure of biodiversity of the planned activities which do not fall under action of appendices 1 and 2 to the Law on environmental impact assessment No. 86/2014, but can make potentially considerable impact on sites of network of Emerald;

– holding procedure of strategic ecological assessment of the program documents and plans having possible essential impact on the environment including on health of the population, according to the Law on strategic ecological assessment No. 11/2017;

– ensuring informing the interested public and public discussions about the planned activities and the program documents and plans, and also ensuring compliance with the principle of participation in decision making provided in the Law on environmental impact assessment No. 86/2014 and the Law on strategic ecological assessment No. 11/2017;".

2. In Article 10:

Item j) to declare invalid;

in Item k) words "documentation on assessment of impact of objects or the planned activities on environment;" shall be replaced with words "characteristics of the planned activities and the report on environmental impact assessment according to the Law on environmental impact assessment No. 86/2014".;
