In recent years in our country the system works aimed at providing reliable legal protection of intellectual property items and provision of high-quality state services are carried out.

At the same time, for the purpose of strengthening of supremacy of justice and the law in our country, creations of the compact and effective administrative personnel which is professionally servicing the population, further strengthening of role and responsibility of judicial authorities in the solution of legal problems of the population are assigned additional tasks in the field of protection of intellectual property items and rendering the state services to the Ministry of Justice of the Republic of Uzbekistan.

In turn, it creates need for accurate and complete reflection of tasks and powers of the Ministry of Justice of the Republic of Uzbekistan for the existing legal acts. Moreover, for the purpose of support of socially vulnerable segments of the population fixing at the legislative level of the privileges provided when rendering certain categories of the state services is important.

This Law makes changes and additions in a row of the laws regulating protection of intellectual property items and also to the articles of some laws connected with provision of the state services in registration of legal entities and to licensing, providing refining of powers of the Ministry of Justice of the Republic of Uzbekistan.

Besides, in the Law of the Republic of Uzbekistan "About the state fee" it is determined that the state services are provided to persons registered in the Unified register of social protection and also persons with disability of I and II groups from fifty percentage discount through the centers of the state services and (or) the Single portal of interactive state services of the Republic of Uzbekistan.

Adoption of law will serve strengthening of protection of intellectual property rights and providing the effective centralized control system in this sphere, and also to improvement of quality of the state services and support of socially vulnerable segments of the population.

Article 1. The text of article 9 of the Law of the Republic of Uzbekistan of May 6, 1994 No. 1060-XII "About legal protection of programs for electronic computers and databases" (Sheets of the Supreme Council of the Republic of Uzbekistan, 1994, No. 5, Art. 136; Sheets of Oliy Majlis of the Republic of Uzbekistan, 2002, No. 4 5, Art. 74, No. 9, Art. 165; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2011, No. 12/2, of Art. 364; 2019, No. 12, Art. 880; 2020, No. 1, Art. 1, No. 10, Art. 593; 2021, 4) to state appendix to No. in the following edition:

"The physical persons or legal entities of the Republic of Uzbekistan, other states having concerning their all personal and property rights or only property rights according to the agreement have the right to registration of the computer program or database. The owner directly or through the representative can register in the State register of software products or the State register of databases the computer program or the database by application in the Ministry of Justice of the Republic of Uzbekistan (further - the Ministry).

The request for official registration of the computer program or the database (further - the request for registration) shall belong to one computer program or one database.

After receipt of the request for registration public institution "Center of intellectual property" under the Ministry of Justice of the Republic of Uzbekistan (further - Public institution) checks availability of necessary documents and their compliance to requirements of rules. In case of positive result of check the Ministry enters the computer program or the database in the corresponding Register, grants to the applicant the certificate on official registration and publishes data on the registered computer programs and databases in the statement of the Ministry.

At the request of Public institution or on own initiative the applicant of the data having the right before the publication in the statement to supplement, specify and correct request materials. In case of negative result of check the Public institution issues to the applicant the document testimonial of refusal in official registration.

Procedure for official registration of the computer programs or databases, including rules of execution of the request for registration are established by the administrative regulations approved by the Cabinet of Ministers of the Republic of Uzbekistan.

Forms of certificates on official registration and structure of the data specified in them are established by the Ministry. The ministry also determines the list of the data published in the statement.

Agreements on transfer of property rights on the computer program or the database can be registered in the Ministry by agreement of the parties.

The data entered in the Register are considered reliable until proved otherwise. Responsibility for reliability of the specified data is born by the applicant.
