About modification of the Forest code of the Kyrgyz Republic

Article 1.

Bring in the Forest code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1999, No. 12, the Art. 534) the following changes:

1) in Article 1:

b) add Article with the paragraph the second the following content:

"Forest ecosystems - the set of the parcels of land, wood, shrubby, grass and other plants including animals and microorganisms, biologically connected in the development and influencing at each other and the external environment.";

c) to state paragraphs of the sixth and seventh in the following edition:

"Reproduction of the wood - complex of the actions directed to process of continuous renewal, production of products and services of the wood.

The woods in settlements - the woods growing within line of settlements.";

d) the seventeenth to declare the paragraph invalid;

e) the twenty first to declare the paragraph invalid;

e) to state the paragraph of the twenty second in the following edition:

"Forest area - primary territorial subdivision which is part of the relevant territorial authority of management of the state forest fund.";

g) in the paragraph twenty third "Government" shall be replaced with words the word "Cabinet of Ministers";

h) in the paragraph the twenty fourth shall be replaced with words words of "forest fund" "the state forest fund";

i) in the paragraph the twenty seventh shall be replaced with words words of "forest fund" "the state forest fund";

j) the twenty ninth to state the paragraph in the following edition:

"Protection of the wood - system of the actions aimed at providing protection of the wood against the fires, illegal fellings, violations of established procedure of forest utilization and other actions, doing harm to the state forest fund, especially protected natural territories and the woods which are on lands of other categories of land fund.";

k) in paragraphs the thirtieth and thirty first shall be replaced with words words of "forest fund" "the state forest fund";

l) add Article with paragraphs the thirty eighth - the fifty sixth the following content:

"Minor forest resources - not wood forest resources to which stubs, bark, fir, pine and fir-tree paws, New Year trees belong.

The state forest protection - the state protection and control of condition of the woods located on lands of the state forest fund, especially protected natural territories, through organized system of republican state body of management of forestry.

The protective woods - the woods having meliorative and sredoobrazuyushchy properties which are used for protection of different objects against adverse natural or anthropogenous effects.

Category of zashchitnost of the woods - classification of forest lands of the state forest fund, especially protected natural territories and the woods which are on lands of other categories of land fund according to the place of growth and their functional purpose concerning which the mode of forest management is set.

Afforestation - artificial cultivation of the wood by creation of forest cultures in such places in which they did not grow earlier, for the purpose of strengthening of sredoobrazuyushchy and sredozashchitny functions of the woods, and also for improvement of biodiversity.

Forest cultures - the trees and bushes which are artificially created by crops or landing of tree and shrubby species of forest plantings.

The woods of high nature protection value - forest, not forest lands of the state forest fund, especially protected natural territories and the woods which are on lands of other categories of land fund, having the high ecological, social and economic, landscape value or value for preserving biodiversity.

The woods having scientific value - the woods, unique on pedigree structure and being subjects to long-term scientific research.

Forest utilization - the types of use of lands of the state forest fund and the woods which are on lands of other categories of land fund, except for restrictions permitted by this Code, provided by this Code.

Forest ecosystem services - the public benefits and material benefits which receive physical persons and legal entities from forest resources.

Forest resources - wood, minor forest resources, wild-growing food resources, herbs and nature protection functions of the wood (the water preserving, klimatoreguliruyushchy, antierosion, soil-protective, recreational, improving, sanitary and hygienic).

National inventory count of the woods - system of actions for determination of condition of the woods, their quantity and quality characteristics.

Plantation - the parcels of land on which wood and wood and shrubby plantings for receipt of wood, fruits, berries for commercial purposes or for the purpose of private use are artificially created. Plantations cannot be located on slopes the steepness more than 25 degrees.
