The territories located on them capital construction projects can be carried to objects of cumulative harm to the environment if they correspond to set of the following criteria:

a) on them the harm to the environment which resulted from last economic and other activity which obligations on elimination were not executed is revealed or were executed not in full, and in borders of such territories are absent:

the excavations which are not liquidated in accordance with the legislation of the Russian Federation about subsoil, boreholes and (or) other constructions connected with use of natural resources;

objects concerning which are not carried out or were executed not in full actions for mitigation of consequences of conducting mining operations (work on liquidation of excavations and exception of access to them, on dismantle of the equipment, demolition of buildings and constructions, recultivation of the used lands, liquidation of ecological and other effects of conducting mining operations);
