About introduction of amendments to the Law of the Kyrgyz Republic "About the status of legal executives and about enforcement proceeding"

Article 1.

Bring in the Law of the Kyrgyz Republic "About the status of legal executives and about enforcement proceeding" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2017, No. 1 (2), the Art. 15) the following changes:

Part 1 of Article 17 to add 1) with Items 10 and 11 of the following content:

"10) decision of the Eurasian economic commission on imposing of penalty;

11) the decision of the Eurasian economic commission obliging the violator to make certain actions.";

Paragraph one of part 1 of Article 18 to state 2) in the following edition:

"1. In the executive document, except for resolutions of the legal executive, the writ, the resolution on the case of offense, notarially certified agreement on payment of the alimony, decisions of the Eurasian economic commission on imposing of penalty and the decision of the Eurasian economic commission, the binding violator to make certain actions, shall be specified:";

Article 52 to add 3) with part of 3-1 following content:

"3-1. The temporary restriction on departure of the debtor on cases on offenses can be lifted by the electronic report created by the automated information system of authorized state body in case of receipt in this system of information on payment of payments on cases on offenses in full and also payments of the performing collection provided by this Law.

The electronic report is the basis for pronouncement of the resolution of the legal executive on cancellation of temporary restriction at departure of the debtor within one working day. The copy of the resolution without delay goes to the debtor.

The procedure for interdepartmental electronic interaction on imposing and/or removal of temporary restriction on departure of the debtor is established by authorized state body together with body of homeland security.".
