About modification of the Code of civil procedure of the Republic of Moldova No. 225/2003 (ensuring application of the Hague Convention about agreements on the choice of court)

The Parliament adopts this organic law.

Art. I. - In the Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: The official monitor of the Republic of Moldova, 2018, Art. No. 285-294, 436), with subsequent changes to make the following changes:

1. Add Article 267 with the Item e-1) of the following content:

"e-1) is available the agreement on the exclusive choice of court for the dispute resolution according to which the parties transferred cognizance of one of degrees of jurisdiction of one of the State Parties of the Convention on agreements on the choice of court signed in the Hague on June 30, 2005;".

2. Part (Article 460 to add 1) with the Item b-1) of the following content:

"b-1) insured property or the place of approach of insurance risk are in the Republic of Moldova;".

3. In Article 461:

Item b) parts (to declare 1) invalid;

in part (the words "and Article 460" to exclude 3).

4. In Article 462:

part (to state 1) in the following edition:

"(1) For the dispute resolution which arose or can arise in connection with the certain civil or commercial legal relation complicated by foreign element, the parties can change cognizance for the dispute resolution by agreement signature about the exclusive choice of court, having transferred cognizance of one of specialized degrees of jurisdiction or to several specialized instances of one of the State Parties of the Convention on agreements on the choice of court signed in the Hague on June 30, 2005.";

add Article with part (1-1) following contents:

"(1-1) Agreement on the exclusive choice of court shall be signed in writing or by means of any other means of communication which provides information access so that it could be used for future addresses.";

in part (2) the words "stipulated in Clause 40," shall be replaced with words "stipulated in Article 40, part (1) Article 41-1 and Article 461,".
