About implementation of cash cash calculations and about modification of some regulations

The Parliament adopts this organic law.

Article 1. Subject of regulation and purpose of the law

(1) This law establishes the main regulatory base for implementation in the territory of the Republic of Moldova of the calculations connected with payment transactions, procedure and limits of implementation of calculations, control of observance of this law, and also applicable sanctions.

(2) the Purpose of this law is stimulation of the payments performed by means of non-cash payment instruments for the purpose of increase in their transparency and safety.

Article 2. Scope

(1) This law is applied to:

a) to legal entities irrespective of type of property or form of business, except for bodies of the public power and public organizations;

b) to permanent missions and branches of legal nonresident persons;

c) to non-profit organizations;

d) to physical persons which perform business activity;

e) to physical persons which perform professional activity in the field of justice or in the field of health care;

f) to physical persons which do not perform business activity and which acquire real estate units or vehicles at other physical persons which are not performing business activity.

(2) This law is not applied to cash calculations which are perfromed according to provisions of the Law on currency control No. 62/2008.

(3) When implementing the payment transactions provided by this law provisions of the Law on the prevention and anti-money laundering and terrorism No. 308/2017 financing shall be observed.

Article 3. Basic concepts

For the purposes of this law the basic concepts are used in value:

professional activity in the field of justice or in the field of health care - as it is determined by Items 362) and 363) of article 5 of the Tax Code No. 1163/1997;
