About modification of some regulations
The Parliament adopts this organic law.
Art. I. – In the Law on pharmaceutical activities No. 1456/1993 (repeated publication: The official monitor of the Republic of Moldova, 2005, Art. No. 59-61, 200), with subsequent changes to make the following changes:
1. Add Article 3 with part (5) the following content:
"(5) the Pharmaceutical companies and organizations determined as service providers according to the Law on cyber security No. 48/2023, bear responsibility for fulfillment of duties on ensuring cyber security, provided by the relevant law.
2. Add Article 9 with part (3) the following content:
"(3) Persons conducting the researches for the purpose of creation of new medicines determined as service providers according to the Law on cyber security No. 48/2023, bear responsibility for fulfillment of duties on ensuring cyber security, provided by the relevant law.".
3. Add Article 16 with part (5) the following content:
"(5) the State supervision and control of observance by the pharmaceutical companies and organizations of the obligations specified in part (5) article 3 of this law, and also behind observance by persons conducting researches for the purpose of creation of new drugs, the obligations specified in part (3) article 9 of this law, are performed by competent authority at the national level in the field of cyber security according to the Law on cyber security No. 48/2023.
Art. II. – Article 4 of the Law on health protection No. 411/1995 (1995, No. 34, Art. 373), with subsequent changes, to add the official monitor of the Republic of Moldova with parts (8) and (9) the following content:
"(8) the Suppliers of medical services determined as service providers according to the Law on cyber security No. 48/2023, bear responsibility for fulfillment of duties on ensuring cyber security, provided by the Law on cyber security No. 48/2023.
