About modification of some regulations (increase in efficiency of procedure for granting of social payments)

Based on the Law No. 289/2004 on temporary disability benefits and other benefits of social insurance (The official monitor of the Republic of Moldova, 2004, Art. No. 168-170, 773), with subsequent changes, and the Law No. 315/2016 on social payments on children (The official monitor of the Republic of Moldova, 2017, Art. No. 19-23, 56), with subsequent changes, DECIDES: the Government

1. In the Order of the Government No. 1478/2002 about benefits to families with children (Official monitor of the Republic of Moldova, 2002, Art. No. 154-157, 1612), with subsequent changes, to make the following changes:

1) in Item 2 of the resolution after the words "for insured persons" to add with the text", lump-sum allowance for entrusting of the adopted child, lump-sum allowance on the child adopted or accepted under guardianship/guardianship, and the monthly allowance on education of the child is more senior than 3 years adopted or accepted under guardianship/guardianship";

2) in the Provision:

a) in Item 21 of the word of "monthly allowance on education of the child" and in Item 2-2 of the word of "monthly allowance on child care" to replace with the text "the benefits provided in subitems c), e), f) and g) item 4";

b) in Item 3 "monthly allowance on education of the child (for insured persons)" to replace the text with the text "the benefits provided in subitems c), e), f) and g) item 4";

c) in Item 3-1:

in the paragraph the second to replace words of "monthly allowance on education of the child" with the text "the benefits provided in subitems c), e), f) and g) item 4";

third to declare the paragraph invalid;

d) add item 4 with subitems e), f) and g) the following content:

"e) lump-sum allowance for entrusting of the adopted child;

f) lump-sum allowance on the child adopted or accepted under guardianship/guardianship;

g) the monthly allowance on education of the child is more senior than 3 years adopted or accepted under guardianship/guardianship.";

e) state Item 4-2 in the following edition:

"4-2. The monthly allowance on education of the child is granted to one of insured parents according to the following options:

a) from the date of, the end of maternity leave following behind day before achievement of 3 years by the child of age;

b) from the date of, the end of maternity leave following behind day, for a period of 24 months. For the period after the expiration of 24 months and before achievement of 3 years by the child of age the monthly allowance on education of the child is not provided;

c) from the date of, the end of maternity leave following behind day, for a period of 12 months. For the period after the expiration of these 12 months and before achievement of 3 years by the child of age the monthly allowance on education of the child is not provided.

If the insured woman does not receive benefit on motherhood, the monthly allowance on education of the child is granted since the birth of the child, except as specified adoptions or accommodations of the child in service of guardianship/guardianship in case of which the monthly allowance on education of the child is granted from the date of the edition of the order about establishment of adoption or about accommodation of the child in service of guardianship/guardianship.";

f) add with Items 4-3 and 4-4 of the following content:

"4-3. The monthly allowance on education of the child is granted based on the statement to insured person (the grandfather, the grandmother, other relative who is directly performing child care) who is on child care leave before achievement of age by it 3 years at all companies where it works, according to the following options:

a) from the date of provision of child care leave and before achievement of 3 years by the child of age;

b) from the date of provision of child care leave for a period of 24 months. For the period child care leave after the expiration of 24 months of leave and before achievement of 3 years by the child of age monthly allowance on education of the child is not provided;

c) from the date of provision of child care leave for a period of 12 months. For the period child care leave after the expiration of 12 months of leave and before achievement of 3 years by the child of age monthly allowance on education of the child is not provided.

If date of provision of child care leave differs at the different companies, the allowance is granted from the date of the last provision of leave.

The option which is originally requested in the application for purpose of monthly allowance submitted to territorial cash desk of social insurance on education of the child cannot be changed further.

4-4. The monthly allowance on education of the child is granted based on the statement to the insured person who adopted the child or accepted it under guardianship/guardianship before achievement of 3 years by the child of age according to the following options:

a) from the date of establishment of adoption or the edition of the order about accommodation of the child in service of guardianship/guardianship and before achievement of 3 years by the child of age, but at least 6 calendar months;

b) from the date of establishment of adoption or the edition of the order about accommodation of the child in service of guardianship/guardianship for the term of the 24th month. For the period after the expiration of 24 months and before achievement of 3 years by the child of age the monthly allowance on education of the child is not provided;

c) from the date of establishment of adoption or the edition of the order about accommodation of the child in service of guardianship/guardianship for the term of 12 months. For the period after the expiration of 12 months and before achievement of age by the child
3 years monthly allowance on education of the child are not provided.

If the insured person who adopted the child or accepted him under guardianship/guardianship used paid leave for a period of up to 90 calendar days, the monthly allowance on education of the child is provided from the date of, the expiration of this leave following behind day.

The option which is originally requested in the application for purpose of monthly allowance submitted to territorial cash desk of social insurance on education of the child cannot be changed further.";
