About introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. This resolution becomes effective from the date of its official publication.

Changes which are made to acts of the Government of the Russian Federation

1. In Basic provisions of forming and state regulation of gas prices, rates for services in its transportation, payments for technological connection of the gas-using equipment to gas distribution networks in the territory of the Russian Federation and payments for technological accession to trunk gas pipelines of the under construction and reconstructed gas pipelines intended for gas transportation from trunk gas pipelines to capital construction projects, and the gas pipelines intended for gas transportation from the natural gas fields to trunk gas pipeline approved by the order of the Government of the Russian Federation of December 29, 2000 No. 1021 "About state regulation of gas prices, rates for services in its transportation payments for technological connection of the gas-using equipment to gas distribution networks in the territory of the Russian Federation and payments for technological accession to trunk gas pipelines of the under construction and reconstructed gas pipelines intended for gas transportation from trunk gas pipelines to capital construction projects, and the gas pipelines intended for gas transportation from natural gas fields to trunk gas pipeline" (The Russian Federation Code, 2001, No. 2, Art. 175; 2013, No. 47, Art. 6104; 2014, No. 2, Art. 137; No. 18, Art. 2185; 2018, No. 6, Art. 897; No. 51, Art. 7991; 2019, No. 8, Art. 801; 2020, No. 13, Art. 1919; 2021, No. 38, Art. 6643; No. 47, Art. 7835; 2022, No. 25, Art. 4334; No. 49, Art. 8695; 2023, No. 48, Art. 8602):

a) in Item 24:

add the subitem "zh" with the words "and (or) to trunk gas pipelines";

add the subitem "z" with the words "and acts on differentiation of operational responsibility with the adjacent gas-distributing and (or) gas transmission organizations";

b) in Item 26 (22):

in paragraphs second and third shall be replaced with words the words "gas transportation is performed" "gas transportation is performed, or the program of gasification of housing and communal services, industrial and other bodies current calendar year provides construction of gas distribution networks to borders of such settlement";

after the paragraph of the fourth to add with the paragraph of the following content:

"Connection (technological accession) of the gas-using equipment of the physical persons (except for accomplishment of actions in borders of the parcels of land, on which are located households of these physical persons) intending to use gas for satisfaction of the personal, family, house and other needs which are not connected with implementation of business (professional) activity is performed without collection of funds from them provided that household of the applicant is located in borders of the territory of conducting gardening by citizens for own needs which is in borders of the settlement in which gas distribution networks on which gas transportation is performed are laid or the program of gasification of housing and communal services, industrial and other bodies current calendar year the construction of gas distribution networks to borders of such settlement, and also in the presence at such persons of the document is provided, confirming the property right or other right to household and the parcel of land provided by the law on which this household is located.";

the fifth to state the paragraph in the following edition:

"Compensation of the loss of income of the gas-distributing organization on accomplishment of the actions which are subject to implementation during technological accession specified in paragraphs the second - the fifth this Item of categories of applicants, is made according to the procedure, provided by the paragraph the fourteenth this Item, and performed till January 1, 2026 (except for the means intended for return of the funds raised by the gas-distributing organization for the contracts signed in 2021 for implementation of actions on technological connection of the gas-using equipment of the applicants specified in paragraphs the second - the fifth this Item, and interest payment for use by them, and also on the redemption of the capital construction projects constructed at the expense of means of the single operator of gasification or the regional operator of gasification during realization of the specified actions).";

word in paragraph six "the paragraph the second" shall be replaced with words "paragraphs the second and fifth";

word in paragraph eleven "paragraphs the second - the fourth" shall be replaced with words "paragraphs the second - the fifth";

c) in Item 26 (25) and paragraph one of Item 26 (words "paragraphs the second - the fourth" shall be replaced with words 26) "paragraphs the second - the fifth".

2. In paragraph seven of Item 1 of the order of the Government of the Russian Federation of May 3, 2001 No. 335 "About procedure for establishment of special allowances to rates for gas transportation by the gas-distributing organizations for financing of programs of gasification of housing and communal services, the industrial and other bodies located in the territories of subjects of the Russian Federation" (The Russian Federation Code, 2001, No. 19, Art. 1942; 2005, No. 7, Art. 560; 2010, No. 49, Art. 6520; 2014, No. 2, Art. 137; 2015, No. 37, Art. 5153; 2019, No. 8, Art. 801; 2020, No. 21, Art. 3282; 2021, No. 38, Art. 6643; 2022, No. 25, Art. 4334; No. 48, the Art. 8602) the words "in paragraphs the second-the fourth" shall be replaced with words 2023, "in paragraphs the second - the fifth".

3. In Rules of connection (technological accession) of the gas-using equipment and the capital construction projects to networks of gas distribution approved by the order of the Government of the Russian Federation of September 13, 2021 No. 1547 "About approval of Rules of connection (technological accession) of the gas-using equipment and capital construction projects to networks of gas distribution and about recognition voided some acts of the Government of the Russian Federation" (The Russian Federation Code, 2021, No. 38, Art. 6641; 2022, No. 49, Art. 8695; 2023, No. 23, Art. 4207):

a) to state paragraph two of Item 2 in the following edition:

"dogazifikation" - connection implementation (technological accession), including the actual accession to gas distribution networks of the gas-using equipment located in the households belonging to physical persons on the property right or on the provided law other right intending to use gas for satisfaction of the personal, family, house and other needs which are not connected with implementation of business (professional) activity taking into account accomplishment of actions within such connection (technological accession) to borders of the parcels of land belonging to the specified physical persons on the property right or on other right provided by the law without collection of payment from physical persons provided that in the settlement in which households of physical persons are located gas distribution networks are laid and is performed gas transportation or the program of gasification of housing and communal services, industrial and other bodies current calendar year the construction of gas distribution networks to borders of such settlement is provided. The dogazifikation is also understood as connection implementation (technological accession), including the actual accession to gas distribution networks of the gas-using equipment located in capital construction projects in which also the medical and obstetrical centers, offices (departments) of general practitioners and medical out-patient clinics which are part of the medical organizations of the state health care system and municipal health care system having licenses for implementation of medical activities intending to use gas for heating and hot water supply of the specified capital construction projects taking into account accomplishment of actions within such connection (technological accession) to borders of the parcels of land occupied with the specified capital construction projects without collection of payment provided that in the settlement are placed medical assistant's in which such capital construction projects are located, gas distribution networks are laid and gas transportation or the program of gasification of housing and communal services is performed, industrial and other bodies current calendar year the construction of gas distribution networks to borders of such settlement is provided. If the territory of conducting gardening by citizens for own needs (further - the gardening territory) is located in borders of the settlement in which gas distribution networks on which gas transportation is performed are laid, or the program of gasification of housing and communal services, industrial and other bodies current calendar year the construction of gas distribution networks to gardening territory borders, connection (technological accession), including the actual connection of the gas-using equipment to gas distribution networks located in the households belonging to physical persons on the property right or on the provided law other right intending to use gas for satisfaction of the personal, family, house and other needs which are not connected with implementation of business (professional) activity, and being in borders of the specified gardening territory is provided it is performed by the contractor to borders of the parcels of land occupied with the specified households without collection of funds from the applicant for rendering service in connection (technological accession);";

b) in Item 11:

state the subitem "an" in the following edition:

"a) the applicant's details (for legal entities - full name and the state registration number of entry in the Unified State Register of Legal Entities, date of its entering into the register, the postal address, contact telephone number and the e-mail address (in the presence), for individual entrepreneurs - the state registration number of entry in the Unified State Register of Private Entrepreneurs, date of its entering into the specified register, the postal address, contact telephone number and the e-mail address (in the presence), for physical persons - surname, name, middle name (in the presence), series, number and date of issue of the passport or other identity document in accordance with the legislation of the Russian Federation, the postal address, contact telephone number and the e-mail address (in the presence);";

add the subitem "b" with words ", and also cadastral number of the parcel of land (in case of application about connection through the single portal) on which are located capital construction projects of the applicant which need to be connected (technologically to attach) to network of gas distribution (will be located)";

c) in Item 16:

to add the subitem "d" after the words "no more than 7 cubic meters" with words ", and also in case of application about connection within the Section VII of these rules";

add with the subitem "l" of the following content:

"k) the protocol of general meeting of members of gardening non-commercial partnership (in case of application about connection by the owner of the household which is in gardening territory borders, or the authorized representative of gardening non-commercial partnership within the Section VII of these rules) containing the decision on carrying out dogazifikation.";

d) add Item 95 with words "(except as specified when actions for connection (technological accession) are performed according to the Section VII of these rules)";

e) add Item 96 with the paragraph of the following content:

"In case of implementation of technological connection of the gas-using equipment belonging to the citizens performing conducting gardening on the parcels of land located in gardening territory borders, the gardening non-commercial partnership has no right to interfere with the contractor in implementation of technological connection of such gas-using equipment.";

e) add Item 119 with the paragraph of the following content:

"The request about dogazifikation goes the owner of the household located in gardening territory borders or the authorized representative of gardening non-commercial partnership addressed to the single operator of gasification or the regional operator of gasification (except for the case provided by paragraph one of this Item).";

g) to state the subitem "an" of Item 120 in the following edition:

"a) lack of gas distribution networks in borders of the settlement in which household of the applicant or capital construction project in which are placed medical assistant's and medical and obstetrical centers, offices (departments) of general practitioners and medical out-patient clinics or the boiler room intended for heating and hot water supply of capital construction projects in which the state or municipal general education organizations and (or) the preschool educational organizations and (or) the medical organizations of the state health care system and municipal health care system are located or the program of gasification of housing and communal services is located of industrial and other bodies current calendar year the construction of gas distribution networks to borders of such settlement is not provided;";

h) state Item 126 in the following edition:

"126. If the territory of gardening is located in borders of the settlement in which gas distribution networks on which gas transportation is performed are laid, or the program of gasification of housing and communal services, industrial and other bodies current calendar year the construction of gas distribution networks to borders of such territory is provided, that connection to networks of gas distribution of the households located in gardening territory borders is performed by the contractor to borders of the parcels of land belonging to the specified physical persons on which such households, without collection of funds from the applicant for rendering service in connection (technological accession) on condition of possibility of construction of network of gas distribution and (or) network of gas consumption in gardening territory borders with compliance with law of the Russian Federation about town-planning activities and the land legislation are located.";

i) Items 3 and 4 of the standard commitment form on the conclusion of the agreement on connection (technological accession) of the gas-using equipment and capital construction projects to the network of gas distribution provided by appendix No. 1 to the specified Rules to state in the following edition:

4. In the order of the Government of the Russian Federation of September 9, 2023 No. 1477 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2023, No. 38, the Art. 6910):

a) add Item 3 with words ", except for the subitem "v" of Item of 2 changes approved by this resolution which becomes effective from the date of entry into force of the order of the Government of the Russian Federation of April 16, 2024 No. 484 "About introduction of amendments to some acts of the Government of the Russian Federation";

b) in the subitem "v" of Item of 2 changes which are made to acts of the Government of the Russian Federation, approved by the specified resolution:

the twelfth - the fourteenth to replace paragraphs with the text of the following content:

"add with subitems "z" - "m" of the following content:

"h) sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation in form according to appendix No. 4 (further - sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation);

twenty third - the twenty sixth to replace paragraphs with the text of the following content:

"6(2). The offers on change of the program of gasification directed by the gas-distributing organizations and the organizations - owners of gas supply systems in public authority of the subject of the Russian Federation (body of the public power of the federal territory) for the purpose of connection implementation (technological accession) of the gas-using equipment to gas distribution networks within dogazifikation and (or) within dogazifikation of boiler rooms according to the Rules of connection (technological accession) of the gas-using equipment and capital construction projects to networks of gas distribution approved by the order of the Government of the Russian Federation of September 13, 2021 No. 1547 "About approval of Rules of connection (technological accession) of the gas-using equipment and capital construction projects to networks of gas distribution and about recognition voided some acts of the Government of the Russian Federation", are subject within 5 working days from the date of their receipt to approval of the single operator of gasification (the regional operator of gasification) in cases if such program of gasification contains actions which are carried out and financed by the specified operators. The specified offers within 8 working days from the date of their receipt in public authority of the subject of the Russian Federation (body of the public power of the federal territory) are subject to inclusion in the program of gasification (in the summary schedule of dogazifikation, the item-by-item schedule of dogazifikation, sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation, the summary schedule of dogazifikation of the territories of gardening, the item-by-item schedule of dogazifikation of the territories of gardening, and also in sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation of the territories of gardening).";

In case of untimely provision by the gas-distributing organization of data on the planned sales amounts and financing of actions within the item-by-item scheduled plan of dogazifikation sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation are determined based on the total quantity of households provided by the summary scheduled plan of dogazifikation, and average cost of connection (technological accession) of capital construction projects to gas distribution networks concerning one household on the subject of the Russian Federation.

Sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation of the territories of gardening are determined based on the data received from the gas-distributing organizations containing list of actions for dogazifikation of the territories of gardening. In case of untimely submission by the gas-distributing organization of data on the planned sales amounts and financing of actions within the item-by-item scheduled plan of dogazifikation of the territories of gardening sales amounts and financings of actions within the item-by-item scheduled plan of dogazifikation of the territories of gardening are determined based on the total quantity of households provided by the summary scheduled plan of dogazifikation of the territories of gardening, and average cost of connection (technological accession) of capital construction projects to gas distribution networks concerning one household in the territory of gardening on the subject of the Russian Federation. ";";

the forty first to state the paragraph in the following edition:
