About introduction of amendments to the Law of Ukraine "About defense purchases" concerning enhancement of legal regulation of pricing in defense purchases during action of legal regime of warlike situation

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About defense purchases" of July 17, 2020 No. 808-IX; with the changes made by the Law of Ukraine of February 24, 2023 No. 2958-IX, such changes:

1. The first offer of part four of Article 2 to add with the words "except the cases provided by this Law".

2. To add article 30 after part two with new part of the following content:

"3. Features of pricing of the public contract (agreement) on defense purchases which consists during action of legal regime of warlike situation:

as a part of the price of the public contract (contract) for delivery of goods, performance of works and provision of services for ensuring needs of the sector of safety and defense, and also other goods, works and services for secured provision of requirements of safety and defense expenses, in particular taxes, charges and other stipulated by the legislation obligatory payments, and profit of the contractor are considered;

if purchase of goods, works and services of defense appointment, and also other goods, works and services for secured provision of requirements of safety and defense during action of legal regime of warlike situation is performed according to the non-competitive procedure of purchases or without carrying out types (procedures) the purchases determined by the legislation, profit level as a part of the price of the public contract (agreement) cannot exceed profit level (limit of profit) established by the Cabinet of Ministers of Ukraine at the time of the conclusion of the corresponding public contract (agreement);
