About introduction of amendments to some laws of Ukraine concerning enhancement of legal regulation of the questions connected with prohibition of alienation of the real estate units acquired (including invested/financed) with use of the housing certificate on acquisition of object of the residential real estate

The Verkhovna Rada of Ukraine decides:

I. Make changes to such laws of Ukraine:

1. In the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383 with the following changes):

Part the fifteenth Article 8 to state 1) in the following edition:

"Introduction by the notary in cases, stipulated by the legislation, information in the Unified register of the powers of attorney, the Heritable register and other unified and state registers functioning in system of the Ministry of Justice of Ukraine in the State register of the property damaged and destroyed as a result of the fighting, acts of terrorism, diversions caused by the armed aggression of the Russian Federation against Ukraine, the Unified register of persons, missing persons in case of special circumstances is not violation of notarial secret";

Item 9 parts one of Article 34 to state 2) in the following edition:

"9) are imposed and remove ban of alienation of real estate (property rights on real estate), objects of construction in progress, future real estate objects, the rights to which are subject to state registration, shares in the property right to such property, and also in the cases established by the legislation - personal estate";

3) in part one of article 41 of figure "71-73" to replace with figures "71, 72";

4) in Article 55:

"In case of availability of prohibition of property acquisition, encumbrance by its mortgage the agreement on alienation of such property makes sure with the consent of the creditor, except the cases established by the law when alienation of such property is forbidden";
