About modification and amendments in the order of the Minister of national economy of the Republic of Kazakhstan of November 19, 2019 No. 90 "About approval of Rules of forming of rates"

I ORDER:

1. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of November 19, 2019 No. 90 "About approval of Rules of forming of rates" (it is registered in the Register of state registration of regulatory legal acts for No. 19617) the following changes and amendments:

in Rules of forming of the rates approved by the specified order:

"Forming and approval of rates using the stimulating method of tariff regulation of the subjects rendering regulated services in spheres of transfer of electrical energy, water supply and (or) water disposal, production, transfer, distribution and (or) supply of heat energy is performed according to Paragraph 3-1 of Chapter 2 of these rules.";

add with Item 242-1 of the following content:

"242-1. In case of availability at the subject of the approved differential tariffs on customer groups, specified in Items 247 and 269 of these rules, the temporary compensating rate for each customer group is determined by the following formulas:

_V1 – the annual amount of regulated services of the first customer group for introduction of the temporary compensating rate considered in the approved tariff estimate, cubic meter/Gcal;

_V2 – the annual amount of regulated services of the second customer group for introduction of the temporary compensating rate considered in the approved tariff estimate, cubic meter/Gcal;

_V3 – the annual amount of regulated services of the third customer group for introduction of the temporary compensating rate considered in the approved tariff estimate, cubic meter/Gcal;

NDK - the amount of unreasonably gained income taking into account base rate of National Bank of the Republic of Kazakhstan, in tenge.

If when calculating of the temporary compensating rate, rates for the second and third customer groups will be below rate of the first group, the temporary compensating rate for all customer groups is determined by the following formula:

1) the physical persons belonging to the category of the population, the organizations which are engaged in production of heat energy within water consumption amounts for own needs in production process of heat energy and amounts of feed in case of provision of services of hot water supply (in case of open hot water supply), the organizations which are engaged in transfer and distribution of heat energy, within amounts of the approved normative technical losses and the organizations providing regulated services in the field of water supply and (or) water disposals - the first group;

2) other consumers - the legal entities who are not part of the first and third groups - the second group;

3) the organizations containing at the expense of budgetary funds - the third group.
