About modification of some legal acts of Ukraine concerning refining of powers of subjects of ensuring civil protection, enhancement of the legislation concerning protection of the population and the territories against effects of emergency situations, the organization and carrying out evacuation of the population, ensuring protection of life and health of citizens

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Water code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 1995, No. 24, the Art. 189):

Article 1 to add 1) taking into account alphabetic procedure with the term of the following content:

"places of mass rest of the population on water objects - the water objects (their part) and the parcels of land adjoining to them, islands, beach areas intended for organized rest of the population determined by local government bodies in the procedure established by the law".

With respect thereto the fifty fourth-seventy fifth to consider paragraphs respectively paragraphs the fifty fifth-seventy sixth;

Item 7 of Article 14 to add 2) with the words "determination of accounting treatment for places of mass rest of the population on water objects";

3) in Article 51:

the eighth to lay out part in such edition:

"In case of determination of such places preference is given to traditionally located places of mass rest of the population on water objects";

after part eight to add with new part of the following content:

"Ensuring protection of life and health of citizens in places of mass rest of the population on water objects is assigned to the water user who took water object in use under lease".

With respect thereto the ninth - the nineteenth to consider parts respectively parts ten - the twentieth.

2. In the Code of civil protection of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2013, Art. No. 34-35, 458):

Part one of Article 1 to state 1) in the following edition:

"1. The code of civil protection of Ukraine governs the relations connected with protection of the population, the territories, the surrounding environment and property against emergency situations, the fires and other dangerous events, response to them, functioning of single state system of civil protection and determines powers of the Cabinet of Ministers of Ukraine, the ministries, other central executive bodies (further - the central executive bodies), the public authorities which are not a part of the system of the central executive bodies (further - other public authorities), Council of Ministers of the Autonomous Republic of Crimea, local public administrations, local government bodies, establishes the rights and obligations of citizens of Ukraine, foreigners and stateless persons, the companies, organizations and the organizations irrespective of pattern of ownership (further - subjects of managing), and also other legal entities";

2) in Article 2 part one:

to add Item 15 after the words "approach of emergency situation" with the words "or dangerous event";

add with Item 21-1 of the following content:

"21-1) links of territorial subsystem of single state system of civil protection - organizational set of governing bodies and forces of civil protection, appropriate subjects of managing which are carrying out tasks of civil protection in the territory of areas, areas in the cities of Kiev and Sevastopol, city territorial communities which administrative centers are the regional centers subordinated to them";

state Item 35 in the following edition:

"35) injured with extraordinary situation face to which physical and/or material damage as a result of emergency situation is caused";

exclude Item 38;

state Item 41 in the following edition:

"41) specialized service of civil protection force of civil protection central and local executive bodies, local government bodies, the companies, organizations, the organizations irrespective of pattern of ownership, combined for accomplishment of tasks in the field of civil protection of the corresponding functional orientation";

add with Item 42-1 of the following content:

"42-1) subform of link of territorial subsystem of single state system of civil protection - organizational set of governing bodies and forces of civil protection, appropriate subjects of managing which are carrying out tasks of civil protection in the territory of city, settlement, agricultural territorial community subordinated to them";

3) in Article 6:

in the paragraph the second word part one "state bodies" shall be replaced with words "public authorities";

the paragraph one of part three after words "central and local executive bodies" to add with words of "other public authorities";

in part four shall be replaced with words the word "formed" "can be formed";

4) in Article 8:

third to add part with Item 13-1 of the following content:

"13-1) training of administrative board of single state system of civil protection for actions in case of mobilization and accomplishment of tasks of civil protection in wartime taking into account regulations of international humanitarian law";

the fourth to state part in the following edition:

"4. Additional tasks of single state system of civil protection during the special period are:

1) during action of warlike situation:

the notification of governing bodies and forces of civil protection of single state system of civil protection, and also the population about threat of application or use of weapons of destruction;

enforcement and implementation of plans of civil protection for the special period;

reduction of governing bodies and forces of civil protection, control centers, communication and warning systems in readiness for actions in the conditions of the special period;

the organization and carrying out rescue and other urgent operations, mitigations of consequences of the emergency situations which resulted from military (fighting) operations including using weapons of destruction;

transfer of governing bodies and forces of civil protection into wartime states;

expansion of the special forming intended for accomplishment of separate tasks of civil protection in the territories and in the settlements carried to groups of civil protection and on objects of the subjects of managing referred to categories of civil protection;

determination of the settlements and areas requiring conducting humanitarian mine clearing, marking of dangerous sites, carrying out cleaning (mine clearing) the territories;

refining of need for protective constructions for the shelter of the population and reduction in readiness of all objects of fund of protective constructions of civil protection, ensuring the round-the-clock access to such objects;
