About introduction of amendments to the Law of Ukraine "About public purchases" and Bases of the legislation of Ukraine on health protection concerning agreements of the managed access

The Verkhovna Rada of Ukraine decides:

I. Introduce in the Law of Ukraine "About public purchases" (Sheets of the Verkhovna Rada of Ukraine, 2019, No. 45, Art. 289 with the following changes) the following changes:

1. Part the fifth Article 3 to add with Item 24 following of content:

"24) the original (innovative) medicines which are subject to agreement purchase of the managed access which consist according to the law the central executive body providing forming and realizing state policy in the field of health care, or according to its order person authorized on implementation of purchases in the field of health care, with the owner of the registration certificate on original (innovative) medicine or the representative authorized by it (further - the applicant).

By results of such purchase within three working days from the moment of the conclusion of the agreement of the managed access in electronic purchasing system the report on this agreement signed without use of electronic purchasing system will be promulgated. In this report information is specified about:

applicant;

international unlicensed name of medicine (in the presence);

trade name of medicine;

form of release and dosage of medicine;

the duration of the agreement of the managed access".

2. To exclude Item 3-4 of the Section X "Final and transitional provisions".

II. Final provisions

1. This Law becomes effective from the date of, its publication following behind day.

2. To add part one of Article 3 of Bases of the legislation of Ukraine on health protection (The sheet of the Verkhovna Rada of Ukraine, 1993, No. 4, Art. 19 with the following changes) taking into account alphabetic procedure with the term of the following content:
