About modification of the Code of penal procedure of the Kyrgyz Republic

Article 1.

Bring in the Code of penal procedure of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:

1) in Article 403:

a) in part 4:

- "Article 417" shall be replaced with words words "Article 406";

b) add with part 5 of the following content:

"5. Determination of Appeal Court about satisfaction or refusal in recovery of the passed term can be appealed in cassation procedure no later than 3 months from the date of its removal.";

Part 3 of Article 439 to state 2) in the following edition:

"3. The judgments of the first instance which took legal effect are not appealed in appeal procedure and also the judgments of appellate instance passed according to claims to resolutions of the investigative judge, except for resolutions on the termination of criminal case according to claims to decisions of officials in pre-judicial production and determinations of Appeal Court about satisfaction or refusal in recovery of the passed term are not subject to revision in cassation procedure.".

Article 2.

This Law becomes effective after ten days from the date of official publication.
