I ORDER:

1. Bring in the order of the acting minister of justice of the Republic of Kazakhstan of July 5, 2023 No. 464 "About approval of Rules of development, approval and state registration of regulatory legal acts" (registered in the Register of state registration of regulatory legal acts at No. 33048) the following amendments:

in Rules of development, approval and state registration of the regulatory legal acts approved by the specified order:

add with Chapter 5 of the following content:

"Chapter 5. Use of the principles of "smart regulation" and Agile in case of development, approval and state registration of regulatory legal acts of the central state bodies

79. For the purpose of application of provisions of this Chapter "smart regulation" is understood as use of the following principles of legal policy:

1) reasonable regulation;

2) transparent regulation;

3) evidential regulation;

4) productive regulation;

5) protection of the rights, freedoms and legitimate interests of the person.

80. Reasonable regulation in the field of departmental regulation is understood as the following:

1) regulation of public work is applied as last resort in case of permission of the questions arising in public life as the quantity of the regulatory measures exceeding reasonable limit creates regulatory burden for her addressees;

2) in case of the solution of the tasks facing developer it is important to look for first of all the alternative methods which are not connected with regulatory intervention;

3) in need of introduction of regulatory measures they are studied regarding the acceptability for achievement of the expected purposes and the smallest extent of restriction of the rights, freedoms and legitimate interests of citizens and the organizations;
