About modification of the Customs code of Ukraine and other laws of Ukraine concerning features of implementation of customs control and customs clearance of separate types of goods
The Verkhovna Rada of Ukraine decides:
I. Bring in the Customs code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2012, Art. No. No. 44-48, 552) such changes:
1. Add Article 232 with part five of the following content:
"5. Customs control and customs clearance of the biomethane moved with pipeline transport through customs border of Ukraine under the external economic agreements (contracts) are performed according to the procedure, stipulated by the legislation Ukraine concerning customs affairs for natural gas.
The customs clearance of biomethane is performed based on data concerning amounts of biomethane which when moving by pipeline transport according to the physical and chemical characteristics can be replaced with the corresponding amount of natural gas or mix of natural gas and biomethane, on each Item of reception-transmission of gas separately.
The customs applicant for implementation of customs clearance of amounts of the biomethane moved with pipeline transport through customs border of Ukraine under the external economic agreements (contracts) shall give to customs authority according to the procedure, determined by this Code:
the periodic customs declaration containing data on number of accounting record concerning producer of biomethane in the register of biomethane, the stipulated in Article 8-1 Law of Ukraine "About alternative types of fuel";
the additional customs declaration containing data on biomethane origin guarantee, the stipulated in Article 8-2 Laws of Ukraine "About alternative types of fuel" on the corresponding amount of biomethane.
The customs clearance of amount of the biomethane moved with pipeline transport through customs border of Ukraine under the external economic agreements (contracts) is performed on condition of observance of requirements of article 8-3 of the Law of Ukraine "About alternative types of fuel".
