About introduction of amendments to some laws of Ukraine concerning distribution of grades of cotton in Ukraine

The Verkhovna Rada of Ukraine decides:

I. Make changes to such laws of Ukraine:

1. The Section IX "Final provisions" of the Law of Ukraine "About protection of the rights to plant varieties" (2002, No. 23, the Art. 163) to add sheets of the Verkhovna Rada of Ukraine with Item 2-1 of the following content:

"2-1. Determine that for action of the warlike situation in Ukraine imposed by the Presidential decree of Ukraine "About introduction of martial law in Ukraine" of February 24, 2022 No. 64/2022, the approved Law of Ukraine "About approval of the Presidential decree of Ukraine "About introduction of warlike situation in Ukraine" of February 24, 2022 No. 2102-IX and by day of entry into force of the Law of Ukraine "About state regulation of genetic and engineering activities and the state control of placement in the market of genetically modified organisms and products" of August 23, 2023 state registration of grade of cotton and/or state registration of the rights to the cotton grade including which is genetically modified upon the demand of the applicant are performed No. 3339-IX without conducting qualification examination.

State registration of the rights to the cotton grade including which is genetically modified is performed on condition of confirmation by the applicant of the property rights to such grade, in particular by the patent granted by any contractual party of the Convention.

On condition of availability of the conclusion about the accepted name of grade of cotton and payment of the corresponding collection and/or the state fee the Competent authority makes the decision on state registration of grade of cotton and/or state registration of the rights to cotton grade in 15-day time from the date of sending the notification on positive results of consideration of the request.

State registration of property right on distribution of grade of cotton and/or state registration of intellectual property rights on grade of cotton are performed according to part four of article 33 of this Law.
