About measures for further strengthening of guarantees of reliable protection of the rights and personal freedoms in operational search and investigative activities

In our country the large-scale work directed to raising on the new level of system of human rights protection on the basis of the principle "For honor and advantage of the person", strengthening of guarantees of protection of the rights and personal freedoms in activities of judicial and law enforcement agencies and also building confidence of the population in law-enforcement system is carried out.

At the same time, judicial and investigative practice shows incomplete involvement of effective mechanisms of providing guarantees of protection of human rights and freedoms, and also availability of need of strengthening of measures for reliable ensuring constitutional rights with court on freedom and security of person of person accused of crime execution.

Proceeding from the priority directions determined in Strategy "Uzbekistan - 2030", for the purpose of increase in efficiency of judicial activities, providing in practice of the principle of equality and competitiveness of the parties in pre-judicial production, and also achievements of effective protection of the rights and freedoms of person in operational search and investigative activities:

1. Agree with the offers of the Supreme Court, Prosecutor General's Office, Ministry of Internal Affairs, Service of state security and the Ministry of Justice providing since January 1, 2025:

implementation of procedure for consideration of question of issue of the sanction on proceeding decisions at stage of pre-judicial production on criminal cases by certain judges - investigative judges in district, city courts on criminal cases;

introduction of position of the investigative judge in district, city courts on criminal cases;

determination of procedure for individual review of the sanctions on proceeding decisions issued by the investigative judge at stage of pre-judicial production on criminal cases of the Republic of Karakalpakstan by court, regional and Tashkent city courts, Military court of the Republic of Uzbekistan only in appellate instance;
