About introduction of amendments to the Code of Ukraine about administrative offenses and other laws of Ukraine in connection with ratification of the Convention of the Council of Europe on prevention of violence against women and domestic violence and fight against these phenomena
The Verkhovna Rada of Ukraine decides:
I. Bring in the Code of Ukraine about administrative offenses (Sheets of the Supreme Council of USSR, 1984, appendix to No. 51, the Art. 1122) the following changes:
1. The second articles 13 after figures "173" to add part with figures "173-2".
2. To state the note to Article 22 in the following edition:
"Note. Provisions of this Article are not applied to the offenses provided by Article part four 121, Article part five 122, Articles 122-2, 122-4, Article part three 123, parts two - the fifth Article 126, by Articles 130, 161-1 and 173-2 of this Code".
3. In Article 38:
third to state part in the following edition:
"Administrative punishment for making of the offenses provided by Articles 173-2 and 173-6 of this Code can be imposed within six months from the date of making of the corresponding offense";
in part four of the word and figure "Articles 212-15, 212-21 of this Code" shall be replaced with words also in figures "parts three - the sixth Article 164-14, Articles 212-15, 212-21 of this Code".
4. State Articles 39-1 and 173-2 in the following edition:
"Article 39-1. The direction on passing of the program for person who committed domestic violence or violence on the basis of sex
In case of making of domestic violence or violence on the basis of sex the court in case of the solution of question of imposing of collection for administrative offense has the right at the same time to resolve issue of the direction of person who committed domestic violence or violence on the basis of sex on passing of the program for such persons provided by the law.
