About introduction of amendments to articles 294 and 383 of the Code of administrative legal proceedings of Ukraine concerning providing the right to appeal of the judgment

The Verkhovna Rada of Ukraine decides:

1. Bring in the Code of administrative legal proceedings of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436) such changes:

Part one of Article 294 to add 1) with Item 28 of the following content:

"28) leaving without allowance of the application given according to the procedure, determined by Article 383 of this Code";

Part the sixth Article 383 to state 2) in the following edition:

"6. In the absence of circumstances of illegality of relevant decisions, actions or failure to act of the subject of powers of authority - the defendant and violation of the rights, freedoms, interests of plaintiff person by it the court takes out determination about leaving of the statement without satisfaction which can be appealed according to the procedure, stipulated in Clause 294 of this Code. In the presence of the bases for allowance of the application the court takes out determination according to the procedure, stipulated in Article the 249th of this Code".

2. This Law becomes effective from the date of, its publication following behind day.
