This Law determines the principles of the organization and activities of road transport.

Chapter 1. General principles of activities of road transport

Article 1. Determination of the main terms

In this Law the provided terms are used in the following value:

road transport - the transport industry providing requirements satisfaction of the population and social production in transportations of passengers and loads by automotive vehicles;

the car - the wheel vehicle which is set in the motion by power source having at least four wheels, intended for movement on trackless roads and used for transportation of people and (or) loads, towing of vehicles, accomplishment of special works;

the automotive vehicle - the wheel vehicle (the bus, cargo and the car, trail car, semitrailer truck) used for transportation of passengers, loads or accomplishment of special working functions (further - the vehicle);

the cargo vehicle - the car on the design and the equipment intended for transportation of goods;

the car with hydrogen fuel element (cell) - the car (the bus, the cargo vehicle) equipped with exclusively electric traction motors (one or several) which work due to the energy received from hydrogen;

the car - the car on the design and the equipment intended for transportation of passengers with the number of places for sitting no more than nine with driver's seat inclusive;

the car plug-in - hybrid – the wheel vehicle equipped with the electric traction motor and the internal combustion engine. The system of accumulation of electrical energy (rechargeable battery) of the car hybrid plug-in has technical capabilities to be loaded from external source of electrical energy;

the bus - the vehicle on the design and the equipment intended for transportation of passengers with the number of places for sitting more than nine with driver's seat inclusive;

the automated system of accounting of payment of journey - the software and hardware complex intended for implementation of accounting of the provided transport services by means of the electronic ticket;

bus station - construction or complex of buildings, constructions, parking and entrances for acceptance, departure, traffic control of buses and servicing of passengers;

the autopavilion - construction at stop for short-term stay of passengers;

bus route - way of passing of the bus between initial and final Items with certain places on the road for landing (disembarkation) of passengers;

bus route city - the bus route which is not going beyond the settlement territory;

bus route suburban - the bus route connecting settlements and which extent does not exceed 50 km;

bus route long-distance - the bus route connecting settlements and which extent exceeds 50 km;

international bus route - the bus route crossing frontier of Ukraine;

bus route public - bus route on which perform regular passenger traffic;

bus route of special transportations - bus route on which perform regular special passenger traffic;

bus route of irregular transportations - bus route on which perform irregular passenger traffic;

automobile carrier - the physical person or legal entity performing on commercial basis or on own account

the automobile self-employed carrier is physical person - the subject of managing which performs on commercial basis or for own funds of transportation of passengers for taxi without application of work of hired drivers". transportations of passengers or (and) loads vehicles;

the ticket - the travel document of the established form containing obligatory details and data which grants to the passenger the right to transport services;

freight transportation - transportation of goods by cargo vehicles;

the freight automobile station - complex of buildings, the constructions intended for accomplishment of cargo, economic works with loads and rendering forwarding services to carriers;

freight terminal (автопорт) - complex of buildings, the constructions equipped with loading means, intended for accomplishment of cargo, economic works with loads, maintenance of automotive vehicles, rendering forwarding and other services to carriers;

the consignor - physical person, physical person entrepreneur or the legal entity who provides to carrier load for transportation and enters the corresponding data in commodity-transport delivery note or other document determined by the legislation on load;

the receiver - physical person, physical person entrepreneur or the legal entity who performs cargo reception and unloading of the vehicle according to the procedure, established by the legislation;

the heavyweight vehicle - the vehicle with load or without load, at least one of weight parameters of which exceeds the admissible maximum weight or axial loading established in the territory of Ukraine;

the large-size vehicle - the vehicle with load or without load, at least one of dimensional parameters of which exceeds the admissible parameters set to the territories of Ukraine;

refusal of dimensional and weight control - any actions or failure to act including fixed in the automatic mode which led to evasion from passing of dimensional and weight control in zone of dimensional and weight control;

domestic transports - transportation of passengers and loads between the settlements located in the territory of one state;

domestic transports - transportation of passengers and/or loads on the territory of Ukraine without crossing of frontier of Ukraine;

the driver - the person who is managing the vehicle and having the corresponding certificate of the established sample;

dimensional and weight control - control of journey of heavy-load and/or large-size vehicles which includes check on compliance to the standard rates of weight or dimensional parameters of such vehicles established by the legislation, availability of permission to movement along certain routes, and also observance of the conditions stipulated in permission and the mode of movement of vehicles;

the traffic schedule - data on time and the sequence of accomplishment of flight;

The parties - the states, the subjects of the international legal relationship participating in process of the international motor transportations, determined by the legislation;

permission to implementation of international carriages by road transport - the document which is issued by authorized bodies of Contracting Parties to the international automobile carriers for entrance, transit through the territory of Contracting Parties, and also implementation of other types of transport, stipulated by the legislation;

permission of executive bodies and local government bodies - the document granting the right to implementation of transportations of passengers on bus route public;

permission of approval of conditions and the modes of transportations - additional permission which is issued by authorized bodies on the drive of the heavyweight and (or) large-size vehicle;

documents on load - the documents determined according to the Customs code of Ukraine, the laws of Ukraine "About transport-forwarding activities", "About transit of loads", other acts of the legislation, including international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, cargo haulings, necessary for implementation, by road transport;

work experience - the term of activities of the subject of managing - automobile carrier which is estimated since the beginning of implementation of economic activity on provision of services on transportation of passengers and/or loads according to the law. In case of the termination of automobile carrier - the legal entity by reorganization (merge, accession, separation, transformation) experience of its work is gained by the newly created legal entity (newly created legal entities). In case of creation of the legal entity, the owner or one of owners of which is the automobile carrier who is the physical person - the entrepreneur whose business activity is stopped, work experience of this physical person - the entrepreneur is acquired by the newly created legal entity (work experience of such newly created legal entity the work experience of that owner which has the largest term of activities for provision of services on transportation of passengers and/or loads is considered);

electric wheel transport means - two - and more wheel vehicle, equipped with exclusively electric traction motors (one or several) and system of accumulation of electrical energy to be loaded (rechargeable battery) which has technical capabilities from external source of electrical energy;

the electrobus bus equipped with exclusively electric traction motors (one or several) and system of accumulation of electrical energy (rechargeable battery);

the electrobus with the extended electrobus course version inventory with the internal combustion engine which is not connected to transmission that is does not participate in movement of the vehicle and is intended only for rotation of electric generator, equipped and is set in motion by exclusively electric traction motors (one or several), system of accumulation of electrical energy (rechargeable battery) which is capable to be loaded by connection to external source of electrical energy;

the electric vehicle (the electric wheel vehicle) - the car equipped with exclusively electric traction motors (one or several) and system of accumulation of electrical energy (rechargeable battery);

the electric vehicle cargo - the cargo vehicle equipped with exclusively electric traction motors (one or several) and system of accumulation of electrical energy (rechargeable battery);

the electric vehicle the car automobile, equipped with exclusively electric traction motors (one or several) and system of accumulation of electrical energy (rechargeable battery);

the customer of transport services - the legal entity or physical person ordering transport services in transportation of passengers or/and loads;

zone of dimensional and weight control - the section of the highway equipped with the corresponding route signs on which automatic, stationary or mobile units of dimensional and weight control are located;

stop - specially equipped Item for expectation of the bus, landing and disembarkation of passengers;

the wheel vehicle - the vehicle intended for movement on trackless roads, used for transportation of people and (or) loads, and also transportation and the drive during movement or on site the equipment installed on it or mechanisms for accomplishment of special working functions, allowed to participation in traffic;

the light personal electric transport means-wheeled vehicle which is equipped and is set in motion by exclusively electric traction motors (one or several) with capacity in the range to 1000 W, system of accumulation of electrical energy (rechargeable battery) which is capable to be loaded by connection to external source of electrical energy, with one, two, three or four wheels which has the maximum constructive speed in the range to 25 kilometers per hour;

international carriages of passengers and loads - transportation of passengers and loads by road transport with crossing of frontier;

the international shuttle (pendular) carriages - the transportations providing straight lines and return trips of groups of passengers from certain place of departure to certain destination;

semitrailer truck - trail car which axis (axes) are placed behind the center of mass of the vehicle (on condition of uniform loading) and equipped with the coupling device providing transfer of horizontal and vertical efforts to other vehicle performing functions of the tractor;

dangerous goods - substances, materials, products, waste of productive and other activity and container from under them which owing to properties inherent in them in the presence of certain factors can become in transit cause of explosion, the fire, damage of technical means, devices, constructions and other objects, to do material damage and harm to the environment, and also to lead to death, injuring, poisoning of people, animals and which according to international treaties which consent to be bound is this the Verkhovna Rada of Ukraine or by results of testing, depending on extent of their impact on the environment or the person, are carried to one of classes of dangerous substances;

irregular passenger traffic - transportations of passengers by the bus ordered by legal entity or physical person with the conclusion of the written agreement on each service in which determine traffic route, date and time of transportations, other conditions of transportations and payment method of service, or transportation on own account;
