About modification of some legal acts of the Kyrgyz Republic in the field of protection of the rights of entrepreneurs and investors

Article 1.

Bring in the Criminal code of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following change:

add with Article 338-1 of the following content:

"Article 338-1. Hindrance of legal business activity

1. Illegal refusal in state registration of the individual entrepreneur or legal entity or evasion from their registration, illegal refusal in issue of special permission (license) for implementation of certain activities or evasion from its issue, illegal restriction of the rights and legitimate interests of the individual entrepreneur or legal entity or other illegal intervention in activities of the individual entrepreneur or the legal entity regardless of form of business if these acts are made by the official with use of the official position with causing considerable harm to the rights and legitimate interests of the individual entrepreneur or legal entity, -

are punished by penalty from 5000 to 10000 settlement indicators or imprisonment for a period of up to two years with confiscation of property or without that, with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to two years.

2. Same act, committed:

1) group of persons;

2) group of persons by previous concert, -

it is punished by penalty from 10000 to 20000 settlement indicators, imprisonment for a period of two up to five years with confiscation of property, with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years.".

Article 2.

Bring in the Code of the Kyrgyz Republic about offenses (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following change:
