About modification of the Labor code of Ukraine concerning establishment of the additional bases of termination of the employment contract at the initiative of the employer and some other questions
The Verkhovna Rada of Ukraine decides:
I. Bring in the Labor code of Ukraine (Sheets of the Supreme Council of USSR, 1971, appendix to No. 50, the Art. 375) the following changes:
1. To add part one of Article 40 with Items 13 and 14 of the following content:
"13) the introduction in legal force the court verdict by which the worker is condemned (except release from serving sentence with testing) for crime execution against bases of homeland security of Ukraine;
14) failure to carry out by the worker of rules of conduct at the company, in organization, the organization regarding the provisions provided by Article part two 142 of this Code".
2. In part one of Article 43 of the word and figure "Items 1 (except case of liquidation of the company, organization, the organization), 2-5, 7 of Article 40" shall be replaced with words also in figures "Items 1 (except case of liquidation of the company, organization, the organization), 2-5, 7, the 14th Article 40".
3. To add article 46 part one after words of "refusal or evasion of obligatory medical examinations, training, instructing and examination on labor protection and fire-proof protection" with the words "conducting functional audit check by the employer who is carried to the list of the objects of state-owned property having strategic importance for economy and safety of the state, and/or objects or operators of critical infrastructure".
4. To add article 142 after part one with two new parts of the following content:
"Rules of conduct at the company, in organization, the organizations which contain provisions, in particular, on employee obligations about nondisclosure of information with limited access, in particular information which is the state or trade secret and also on working conditions with confidential information can be component of employment policies and procedures.
