About modification of article 155 of the Law of Ukraine "About judicial system and the status of judges" concerning the organization of work of the courts
The Verkhovna Rada of Ukraine decides:
1. Article 155 of the Law of Ukraine "About judicial system and the status of judges" (Sheets of the Verkhovna Rada of Ukraine, 2016, No. 31, Art. 545; 2017, Art. No. 7-8, 50, No. 48, Art. 436; 2018, 35, the Art. 267) to add No. with part twelve of the following content:
"12. In case of change of territorial cognizance of the legal cases considered in the court, according to the procedure, provided by part seven of article 147 of this Law, and absence in such court of the judges performing the justice, administrative powers of the chairman of justices necessary for providing the proper organization of work of court as the legal entity concerning representative office of such court as public authority in the intercourses with other public authorities, local government bodies, physical persons and legal entities the chief of staff of court or its deputy performs.
If in local or Appeal Court, the specified in paragraph one of this part, there are also no chief of staff of court and its deputy, the administrative powers of the chairman of justices provided by paragraph one of this part are performed by the acting as the chief of staff of court. The decision on appointment of the acting as the chief of staff of court is made by the Chairman of Public judicial administration of Ukraine, the chief of the relevant territorial administration of Public judicial administration of Ukraine without approval of the chairman of the relevant court. The acting as the chief of staff of court performs fulfillment of duties of the chief of staff of court before appointment of the corresponding head.
The chief of staff of court, his deputy or the acting as the chief of staff of court performs the administrative powers of the chairman of justices provided by paragraph one of this part until appointment, election, transfer or the end of business trip of at least one judge".
