Article 1

Bring in the Federal Law of January 12, 1995 No. 5-FZ "About veterans" (in edition of the Federal Law of January 2, 2000 No. 40-FZ) (The Russian Federation Code, 1995, No. 3, Art. 168; 2000, No. 2, Art. 161; 2004, No. 35, Art. 3607; 2008, No. 9, Art. 817; No. 29, Art. 3410; No. 52, Art. 6224; 2009, No. 18, Art. 2152; No. 30, Art. 3739; 2013, No. 48, Art. 6165; 2016, No. 1, Art. 8; No. 52, Art. 7493; 2020, No. 8, Art. 913; No. 52, Art. 8577; 2023, No. 1, Art. 16; No. 18, Art. 3214) following changes:

Item 1 of Article 5 to state 1) in the following edition:

"1. Veterans of military service are the military personnel including transferred to the reserve (resignation):

1) passing (passing) military service in the Armed Forces of the Russian Federation, other troops, military forming and bodies in which the legislation of the Russian Federation provides military service, Armed Forces of the USSR, the Joint Armed Forces of the State Parties of the Commonwealth of Independent States created according to the Charter of the Commonwealth of Independent States, or constantly living in the Autonomous Republic of Crimea and the city of Sevastopol on the date of acceptance to the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation of new subjects - the Republic of Crimea and the federal city of Sevastopol, passing military service in the parts and the organizations of the Armed Forces of Ukraine, other troops, military forming and bodies deployed in the territories of the Autonomous Republic of Crimea and the city of Sevastopol in which the legislation of Ukraine provided military service, or constantly living as of September 30, 2022 in the territories of the Donetsk People's Republic, the Luhansk People's Republic or come out to the permanent residence to the Russian Federation, including through the territories of the third states, from the territory of the Donetsk People's Republic during the period from April 7, 2014 to September 29, 2022, about the territories of the Luhansk People's Republic during the period from April 27, 2014 to September 29, 2022 which were passing in the territories of the specified republics military service in the Armed Forces of Ukraine, Armed Forces of the Donetsk People's Republic, National militia of the Luhansk People's Republic, military forming and bodies of Ukraine, the Donetsk People's Republic, the Luhansk People's Republic, or constantly living as of September 30, 2022 in the territories of the Zaporizhia region, Kherson region or came out to the permanent residence to the Russian Federation including through the territories of the third states, from the territories of the Zaporizhia region, Kherson region during the period from February 24, 2022 to September 29, 2022, passing in the territories of the specified areas military service in the Armed Forces of Ukraine, military forming and bodies of Ukraine, military civil authorities of the Zaporizhia region, military civil authorities of the Kherson region provided that they are awarded by awards or medals of the USSR or the Russian Federation, or are awarded by distinctions of the Russian Federation, or are awarded honorary titles of the USSR or the Russian Federation, or are awarded by certificates of honor of the President of the Russian Federation or thanks of the President of the Russian Federation are awarded, or awarded by departmental distinctions of the Armed Forces of the Russian Federation, other troops, military forming and bodies in which the legislation of the Russian Federation provides military service, or awarded by awards of the Donetsk People's Republic, the Luhansk People's Republic, or are awarded by departmental distinctions of Armed Forces of the Donetsk People's Republic, National militia of the Luhansk People's Republic, military forming and bodies of the Donetsk People's Republic, the Luhansk People's Republic and have the general duration of military service of 20 years and more;

2) passing (passing) military service in the Armed Forces of the Russian Federation, other troops, military forming and bodies in which the legislation of the Russian Federation provides military service, Armed Forces of the USSR, the Joint Armed Forces of the State Parties of the Commonwealth of Independent States created according to the Charter of the Commonwealth of Independent States, Armed Forces of the Donetsk People's Republic, National militia of the Luhansk People's Republic, military forming and bodies of the Donetsk People's Republic, the Luhansk People's Republic, become disabled people owing to wound, contusions, mutilations or diseases got in connection with fulfillment of duties of military service.";

2) in Article 23.1:

a) state Item 7 in the following edition:

"7. Monthly money payment is made according to the procedure, determined by this Article and the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of social protection of the population. To combat veterans from among persons specified in subitems 1, 1.1, 2.2 - 2.4 of Item 1 of article 3 of this Federal Law, monthly money payment is established by territorial authorities of Fund of pension and social insurance of the Russian Federation from the date of recognition of specified persons by combat veterans.";

b) add with Items 7.1 - 7.3 following of content:

"7.1. To the combat veterans from among persons specified in subitems 1, 1.1, 2.2 - 2.4 of Item 1 of article 3 of this Federal Law who did not exercise the right to monthly money payment, the specified payment is established in procedure without application based on the data on execution of the certificate of the combat veteran received by Fund of pension and social insurance of the Russian Federation from federal executive bodies, other federal state bodies performing certification of the combat veteran.

7.2. Terms, procedure and format of interdepartmental information exchange of Fund of pension and social insurance of the Russian Federation with the federal executive body, other federal state body performing certification of the combat veteran are determined by the agreement on interdepartmental information exchange. The standard form of the agreement on interdepartmental information exchange affirms the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of social protection of the population.

7.3. Terms and procedure for submission of data on execution of the certificate of the combat veteran to persons specified in subitems 1, 1.1, 2.2 - 2.4 of Item 1 of article 3 of this Federal Law, data on which are the state secret which pass military service (service), are subject to the state protection and the state protection, in Fund of pension and social insurance of the Russian Federation, and also establishments of monthly money payment by it are determined by the federal executive body providing protection of data concerning the specified category of persons and Fund of pension and social insurance of the Russian Federation.".

Article 2

Provisions of article 5 of the Federal Law of January 12, 1995 "About veterans" (in edition of this Federal Law) are applied No. 5-FZ to the persons who were constantly living as of September 30, 2022 in the territories of the Donetsk People's Republic, the Luhansk People's Republic or came out to the permanent residence to the Russian Federation, including through the territories of the third states, from the territory of the Donetsk People's Republic during the period from April 7, 2014 to September 29, 2022, from the territory of the Luhansk People's Republic during the period from April 27, 2014 to September 29, 2022, passing in the territories of the specified republics military service in the Armed Forces of Ukraine, Armed Forces of the Donetsk People's Republic, National militia of the Luhansk People's Republic, military forming and bodies of Ukraine, the Donetsk People's Republic, the Luhansk People's Republic, or constantly living as of September 30, 2022 in the territories of the Zaporizhia region, Kherson region or come out to the permanent residence to the Russian Federation, including through the territories of the third states, from the territories of the Zaporizhia region, Kherson region during the period from February 24, 2022 to September 29, 2022, passing in the territories of the specified areas military service in the Armed Forces of Ukraine, military forming and bodies of Ukraine, military civil authorities of the Zaporizhia region, military civil authorities of the Kherson region provided that they were not involved in fighting as a part of the Armed Forces of Ukraine, military forming and bodies of Ukraine, did not make illegal actions against the Russian Federation and its population, illegal actions against the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region, The Kherson region and their population or did not assist in making of such actions.
