In recent years in our country system work on effective use of energy resources, prevention of cases of their plunder and implementation of market mechanisms by investment attraction to this sphere is carried out.
At the same time there is need of further enhancement of procedure for debt collection for the energy resources consumed by physical persons, and also procedure for the simplified enforcement proceeding and issue of the writ.
This Law in the Law of the Republic of Uzbekistan "About execution of court resolutions and acts of other bodies" introduces the requirement that before giving to competent authority or the official of the statement for collection of obligatory payments for the consumed electric power and natural gas the documents confirming shutdown of the debtor - physical person from networks of energy resources shall be attached to executive documents. In case of failure to carry out of this requirement the state contractor returns the executive document.
For the purpose of simplification of the procedure of collection of postage expenses the procedure for the simplified enforcement proceeding extends to court documents about collection of postage expenses from debtors - physical persons. Within the simplified enforcement proceeding the obligation according to the notice of the court or other body which issued the executive document on the termination of enforcement proceeding in case of cancellation of court resolution or the act of other body based on which this executive document is issued, or in case of cancellation or recognition invalid this executive document is also assigned to the state contractor.
