About modification and amendments in the order of the Minister of investments and development of the Republic of Kazakhstan of June 30, 2017 No. 409 "About approval of Rules of state registration of civil aircrafts of the Republic of Kazakhstan and the rights to them"

I ORDER:

1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of June 30, 2017 No. 409 "About approval of Rules of state registration of civil aircrafts of the Republic of Kazakhstan and the rights to them" (it is registered in the Register of state registration of regulatory legal acts for No. 15553) the following changes and amendments:

Rules of state registration of civil aircrafts of the Republic of Kazakhstan and the rights to them approved by the specified order:

add with Items 56-1, 56-2 and 56-3 of the following content:

"56-1. For receipt of the certificate on registration of pilotless aviation system the applicant submits to authorized organization through the portal the request for accounting of pilotless aviation system in form, according to appendix 10-1 to these rules and (or) documents according to the list, stipulated in Item the 8th list of the main requirements to rendering the state service "Registration of Pilotless Aviation System" (further – the List of the main requirements) according to appendix 10-2 to these rules.

The list of the main requirements to rendering the state service including result of rendering, and also other data taking into account features of provision of the state service are stated in the list of the main requirements.

After the address through the portal to the applicant the status about adoption of the request for rendering the state service with indication of the date of receipt of result of rendering the state service goes to "personal account".

In case of the direction of documents by means of the portal they make sure the EDS of the applicant.

In case of failures of the information system containing necessary data for rendering the state service, the authorized organization from the moment of detection of emergence of technical failures without delay notifies the operator of information and communication infrastructure of "the electronic government" by means of sending an inquiry in single support service.

56-2. The authorized organization performs registration of the request in day of their receipt.

In case of application day of acceptance does not enter rendering the state service in time.

The authorized organization receives data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur from the corresponding state information systems through lock of "the electronic government".

In case of the address of the applicant after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, registration of the request on rendering the state service is performed the next working afternoon.

56-3. In case of representation by the applicant of incomplete document package according to the list provided in the list of the main requirements and (or) documents with the expired effective period the authorized organization refuses reception of an application within 3 (three) working days.

The refusal does not interfere with the repeated address.

By provision by the applicant of complete document package, according to the list of documents, provided by the list of the main requirements, the authorized organization accepts the request and documents.";

"57. By results of consideration of the request for issue of the certificate on registration of pilotless aviation system the authorized organization grants the certificate on registration of pilotless aviation system in form according to appendix 11 to these rules or the motivated answer about refusal in form according to appendix 11-1 to these rules in rendering the state service in the bases specified in Item 9 of the list of the main requirements and directs to the portal in "personal account" of the applicant in electronic form signed by the EDS of the authorized person of authorized organization.

The certificate on registration of pilotless aviation system is granted for the term of 5 years or on the duration of the agreement of lease.

In case of identification of the bases for refusal in rendering the state service the authorized organization notifies the applicant on the provisional solution about refusal in rendering the state service, and also time, date and the place (method) of carrying out hearing for opportunity to express to the applicant line item according to the provisional solution.

The notification on hearing goes at least in 3 (three) working days prior to completion of term of rendering the state service according to article 73 APPK RK. Hearing is carried out no later than 2 (two) working days from the date of the notification.

Following the results of hearing the result of rendering the state service, or motivated refusal on form according to appendix 11-1 to these rules in rendering the state service is created.";

add with Item 57-2 of the following content:

"57-2. In case of detection of mistakes in the Certificate on registration or receipts of the request about the made mistake, the authorized organization makes corrections of 3 (three) working days in time.";

"58. Account of pilotless aviation systems is kept by authorized organization in the register of pilotless aviation systems of civil aviation of the Republic of Kazakhstan (further – the Register of pilotless aviation systems).

Accounting numbers of registration of pilotless aviation systems shall correspond to their sequence numbers in the Register of pilotless aviation systems.
