About introduction of amendments to the Law of the Kyrgyz Republic "About renewable energy resources"

Article 1.

Bring in the Law of the Kyrgyz Republic "About renewable energy resources" (the newspaper of "Erkin-limited liability partnership" of July 5, 2022 No. 58) the following changes:

1) part 2 of Article 2 to recognize invalid;

2) regarding 1 Article 3:

a) in Item 18 to exclude the word "once";

b) add with Item 28 of the following content:

"28) limit of rate - the maximum size of the prices of all types of energy received from RES. The limit of rate can go for lowering.";

3) in Article 12:

a) Item 7 in paragraph one the word "rate" shall be replaced with words "limit of rate";

b) state Item 19 in the following edition:

"19) electricity tariffs, developed by installations with use of RES within the investment agreement and (or) the agreement on public-private partnership, are subject to monthly indexation according to the procedure, determined by the Cabinet of Ministers of the Kyrgyz Republic taking into account change of the exchange rate of foreign currency in relation to national currency;";

c) add with Item of 21 following contents:

"21) allocation by the subject of RES of 1% of total amount of the developed electrical energy with use of RES for benefit of local government body in the territory of which object of RES is located.";

Article 17 to add 4) with parts 1-1 and 1-2 of the following content:

"1-1. The grace period on electrical energy provided for subjects of RES before entry into force of this Law continues to be effective before the termination of term of grace period with calculation of the rate for electrical energy for subjects of RES established by this Law.
