About some questions of export of oil products from the territory of the Republic of Kazakhstan

According to the subitem 11) of Item 1 of Article 6 and the subitem 1) of Item 2 of article 22 of the Law of the Republic of Kazakhstan "About homeland security of the Republic of Kazakhstan", with article 29 of the Agreement on the Eurasian Economic Union, and also Section 10 of Appendix 7 to the above-stated Agreement, we ORDER:

1. Impose export ban from the territory of the Republic of Kazakhstan, including in state members of the Eurasian Economic Union:

1) road transport of gasolines, diesel fuel and separate types of oil products (the CN FEA EEU of 2709 of 00, of 2710, of 2902, of 3403, of 3811, the 3826th 00), except for lubricating oils (the CN FEA EEU 2710 19 820 0, 2710 19 840 0, 2710 19 860 0, 2710 19 880 0, 2710 19 920 0, 2710 19 940 0, 2710 19 980 0, 3403 19 900 0, 3403 91 000 0), except for export in the gasoline tanks provided by manufacturing plant of automotive vehicles, aviation fuel for carrying out research works on matching of additives, qualification and laboratory researches of samples from trial batch for the purpose of statement on industrial production, approval and/or reapproval of technology of industrial production of aviation fuel (fuel for jet engines), on condition of approval of authorized body in the field of production of oil products and availability of the contract with the organization, authorized on carrying out the above-stated works and the letter with indication of quantity of samples (tests), necessary for these purposes, and amounts of aviation fuel, and also separate types of the oil products which are exported within the humanitarian assistance according to the decision of the Government of the Republic of Kazakhstan for the period from September 29, 2024 to March 29, 2025;

2) railway transport of oil products with codes of the CN FEA EEU 2710 12, except for gasoline export (the CN FEA EEU 2710 12 450 0, 2710 12 490 0, 2710 12 412 0, 2710 12 413 0) according to the delivery plans approved according to Item 7 of article 18 of the Law of the Republic of Kazakhstan "About state regulation of production and turnover of separate types of oil products" and also export of oil products within provision of the humanitarian assistance and (or) help given for the purpose of natural disaster response, accidents or catastrophic crashes for the period from February 1, 2025 to March 29, 2025.

1-1. Impose for up to June 30, 2025 export ban from the territory of the Republic of Kazakhstan out of limits of customs area of the Eurasian Economic Union of light distillates (the Commodity Nomenclatures of Foreign Economic Activity codes 2710 12 110 1 - 2710 12 310 0, 2710 12 700 0 - 2710 12 900 8), aviakerosene and diesel fuel (the Commodity Nomenclatures of Foreign Economic Activity codes 2710 19 110 0 - 2710 19 460 0), gasoils (the Commodity Nomenclatures of Foreign Economic Activity codes 2710 20 110 0 - 2710 20 190 0), toluene, xylol (the Commodity Nomenclatures of Foreign Economic Activity codes 2902 30 000 0, 2902 41 000 0, 2902 42 000 0, 2902 44 000 0), bitumen oil (the Commodity Nomenclature of Foreign Economic Activity code 2713 20 000 0).

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in case of interaction with the Border service of Committee of homeland security of the Republic of Kazakhstan within the competence to take necessary measures for ensuring execution of Item of 1 present of the joint order in the procedure established by the legislation of the Republic of Kazakhstan.

3. To render the Ministry of Internal Affairs of the Republic of Kazakhstan within the competence assistance on non-admission of the cases of commodity exportation specified in Item of 1 present of the joint order, in the gasoline tanks inappropriate to the standards provided by manufacturing plant of automotive vehicles.

4. To department of transportation and oil refining of the Department of Energy of the Republic of Kazakhstan to notify the Ministry of Trade and integration of the Republic of Kazakhstan on need in accordance with the established procedure to inform the Eurasian economic commission on introduction of 1 present of the joint order of prohibition specified in Item.

5. To provide to department of transportation and oil refining of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten calendar days from the date of state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

6. To impose control of execution of this joint order on the vice-Ministers of Energy supervising the corresponding direction, finance, internal affairs and the vice-chairman of Committee of homeland security of the Republic of Kazakhstan - Directors of the Border service.

7. This joint order becomes effective since September 29, 2024 and is subject to official publication.
