In recent years in the country consecutive reforms on ensuring independence of judicial authority, openness and transparency of activity of the courts are performed that served strengthening of guarantees of protection of the rights and legitimate interests of citizens and subjects of entrepreneurship.
At the same time ensuring the principle of competitiveness of the parties in legal proceedings, effective protection of state interests requires further specification of the procedural rules concerning participation of the prosecutor by consideration by courts of civil, economic and administrative cases and also appeal of the court resolutions adopted by results of their consideration.
This Law to the Code of civil procedure of the Republic of Uzbekistan makes the changes and additions providing the prosecutor's right for the purpose of protection of the interests of the state protected by the law to be involved in trial of the cases connected with land legal relationship, state-owned property, compensation of the damage caused to the state and penalties from the government budget and also on the address with the petition for protection of interests of the state.
The changes providing participation of the prosecutor in trial on the cases connected with land legal relationship, state-owned property, violation of the law about environmental protection, penalties from the government budget, recognition of the property right to unauthorized construction, determination of the fact of ownership and use as private property, collection of customs payments are made to the Economic Procedure Code of the Republic of Uzbekistan.
