About some questions of consideration by courts of administrative cases in auditing procedure

Due to the changes and additions made to the Code of the Republic of Uzbekistan about administrative legal proceedings and also for the purpose of ensuring uniform and correct use of the provisions of the law, being guided by article 22 of the Law "About Courts", the Plenum of the Supreme Court of the Republic of Uzbekistan decides:

1. Draw the attention of courts that review of administrative cases in auditing procedure is important part of legal institution of the review of court resolutions providing their legality and justification, the correct application of regulations of the substantive right by courts and observance of requirements of the procedural legislation.

2. Explain that the list of persons who have the right to appeal (to protest) court resolution in auditing procedure is provided in article 249 of the Code of the Republic of Uzbekistan about administrative legal proceedings (further - KOAS).

At the same time according to the legislation some persons have the right to make the complaint in auditing procedure about court resolution for the benefit of other persons even if are not person participating in case (for example, Chamber of Commerce and Industry of the Republic of Uzbekistan for the benefit of the members).

The document confirming its powers (article 59 KOAS) shall be attached to the claim in auditing procedure for the legal representative of person having the right to appeal court resolution in auditing procedure (parents, adoptive parents, the guardian, the custodian, etc.).
