About modification of the Order of the Government No. 377/2018 about approval of institutional base and the mechanism of coordinating and management of the external help

The government DECIDES:

1. In the Order of the Government No. 377/2018 about approval of institutional base and the mechanism of coordinating and management of the external help (Official monitor of the Republic of Moldova, 2018, 133-141 Art. 419), with subsequent changes, to make the following changes:

1.1. in acceptance formula of "article 7 of the Law No. 136 from on July 7, 2017 about the Government" to replace the text with the text "and the Item h 1) of article 7 of the Law No. 136/2017 on the Government";

1.2. add with Item 1-1 of the following content:

"1-1. Approve Regulations on the mechanism of the conclusion and entry into force of public agreements according to appendix No. 11.";

1.3. declare Item 2 invalid;

1.4. state appendix No. 1 in the following edition:

Regulations on institutional base and mechanism of coordinating and management of the external help

I. General provisions

1. The regulations on institutional base and the mechanism of coordinating and management of the external help (in further Yo-the Provision) establish the principles and procedures determining:

1.1. the institutional base relating to the external help;

1.2. mechanism of coordinating and management of the external help.

2. The purpose of this provision is providing:

2.1. effective use of the external help for achievement of national priorities and requirements of development of the Republic of Moldova;

2.2. coordination and complementarity between the tools provided by community of external partners in development, and requirements of development of the Republic of Moldova;

2.3. the coordinated support for the purpose of accomplishment of obligations assumed before the international community and, in particular, in front of the European Union;

2.4. steady financial management by the external help;

2.5. uses of national systems and procedures in the course of coordination and management of the external help;

2.6. the transparent, coordinated and comprehensive dialogue between community of external partners in development, national authority on coordination of the external help and beneficiaries;

2.7. developments of national institutional capacity for satisfaction of own needs for development;

2.8. visualization of the external help;

3. The government provides accomplishment in national context of obligations assumed at the international level in the field of increase in efficiency of the external help, such as Parisian declaration (2005), the Akkrsky action program (2008), Bussansky obligations (2011), the Mexican communique (2014), the Agenda in the field of sustainable development 2030, accepted by member countries of the United Nations (2015), and also the obligations following from the status of the candidate country on the accession to the European Union".

4. In planning process and approvals of projects and programs of the external help the Government provides coordination between the external help, the established national and industry priorities of development and the budget calendar approved according to provisions of the Law No. 181/2014 on public finance and budget and tax responsibility.

5. In planning process and approvals of new projects and programs of the external help the Government will provide use of the budget and tax principles and rules according to provisions of the Law No. 181/2014 on public finance and budget and tax responsibility and the Law No. 419/2006 on debt of the public sector, the state guarantees and the state recrediting.

6. The government recognizes importance of the transparent, coordinated and comprehensive dialogue on the external help with community of external partners in development.

7. The government pays special attention to permanent increase in level of development of the external help and shall strengthen the institutes, systems and procedures for ensuring more effective and steady use of the available resources.

8. Requirements of this provision do not extend on:

8.1. the external help received in the form of donations, the humanitarian assistance, philanthropic means and sponsorship;

8.2. the external help provided to directly private sector by the international public associations and also the external help received by the public associations registered in the Republic of Moldova, except for the programs approved at the level of the country/government, intended for public associations and private sector, or programs which will be realized with their support;

8.3. framework of cooperation of the central bodies of the public management with the international organizations providing mutual protection of interests of safety;

8.4. the external help provided to directly National Bank of Moldova, except for the projects/programs approved at the level of the Government for the purpose of development of institutional potential and/or improvement of material hardware of National Bank of Moldova.

9. For the purposes of this provision the following concepts are used:

9.1. the external help – the financial and technical assistance provided to the Republic of Moldova, the Government and/or other bodies of the public power by community of external partners in development;

9.2. financial aid (financial cooperation) – financial support in the form of the credits, grants, including deliveries of goods and/or works for implementation of projects/programs;

9.3. technical assistance (technical cooperation) – target support / help in form of knowledge sharing and experience, including technologies, methodologies and techniques within projects/programs;

9.4. national authority on coordination – the body equipped with function of coordinating at the national level of the external help provided by community for external partners in development;
