About change of the Procedure of the concession or lease of the right to use limited resources approved by the Resolution of Administrative board of the National agency on regulation in the field of electronic communications and information technologies No. 08 of February 25, 2010

Based on Item a) parts (1) Article 10 and part (2) article 31 of the Law on electronic communications No. 241/2007 (repeated publication: The official monitor of the Republic of Moldova, 2017, No. 399 – 410, the Art. 679), with subsequent changes, the DECIDES: NAREKIT Administrative board

1. The procedure of concession or lease of the right to use limited resources approved by the Resolution of Administrative board of the National agency on regulation in the field of electronic communications and information technologies No. 08 of 25.02.2010 (Official monitor of the Republic of Moldova, 2010, 35, Art. 138), with subsequent changes, to change No. as follows:

1) in all text of the procedure of the word: "the decision on acceptance of concession" and "solutions of concession" in any grammatical form shall be replaced with words "the decision on concession" in the necessary grammatical form;

2) in Item 3:

- 1) to add the subitem with the text: "except for licenses to use of radio channels or radio frequencies for analog broadcasting networks and/or stations";

- 3) to exclude the subitem;

To add 3) with Item 3-4 of the following content:

"3-4. Any contract (agreement) which subject is the concession (transfer) of the rights granted by the license concluded without receipt of prior consent of the agency, is invalid";

Item 6 to add 4) with the subitem 4) of the following content:

"4) if use of radio frequencies is harmonized at the international level or at the European Union level, observance by the cessionary of conditions of the harmonized use.";
