Z., having considered based on Article 40, parts one of Article 116 and part four of article 122 of the Constitution of the Republic of Belarus the collective address of citizens concerning constitutionality of legal regulation of questions of content of persons in special receivers under law-enforcement bodies, established the following.
1. The organization and procedure for activities of special receivers are regulated by the Regulations on special receivers under law-enforcement bodies (further - the Provision) approved by the order of the Ministry of Internal Affairs of the Republic of Belarus of October 18, 1999 No. 206 (The national register of legal acts of the Republic of Belarus, 2000, No. 16, 8/1561).
Special receivers under law-enforcement bodies (in dalneyshemspetspriyemnik) according to Item 1 of the Provision are the organizations intended, in particular, for content of persons who are administratively detained for making of offenses for which by court collection in the form of administrative detention, and also persons subjected to administrative detention can be applied. In case of impossibility of creation of detention center the listed persons can contain in temporary detention centers of law-enforcement bodies in the cameras which are specially allocated for them with distribution of detention regime conditions on them provided for detention centers (Provision Item 5).
