"Article 129. Cancellation of the writ
1. In case of receipt at the scheduled time of the debtor's objections concerning execution of the writ the judge repeals the writ. In determination about cancellation of the writ the judge explains to the claimant that requirement declared to them can be imposed according to the procedure of claim production. Copies of determination of court about cancellation of the writ go to the parties no later than three days after day of its removal.
2. The debtor's objections which arrived in court after stipulated in Clause 128th of this Code of term are not considered by court and return to person by whom they were given, except for case if this person proved impossibility of representation of objections at the scheduled time owing to circumstances what it shall be specified in determination about cancellation of the writ. The private complaint for motive of lack of reasonable excuses of representation by the debtor of objections after fixed term can be made about this determination.
3. In case of cancellation of the writ about collection of the alimony for minor children and satisfactions of requirements of the claimant according to the procedure of claim production such requirements are satisfied for the period during which the alimony was subject to collection according to the writ. At the same time for the period, preceding filing of application about pronouncement of the writ, the alimony can be awarded according to Item 2 of article 107 of the Family code of the Russian Federation.".
