About introduction of amendments to the Criminal code of Ukraine and the Criminal Procedure Code of Ukraine concerning enhancement of regulation of agreements on recognition of guilt in criminal proceedings of rather corruption criminal offenses and criminal offenses connected with corruption
The Verkhovna Rada of Ukraine decides:
1. Make changes to such legal acts of Ukraine:
1) in the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):
in Article 53:
in part one of the word "in the Special part of this Code" shall be replaced with words "this Code";
the first offer of part two to state in the following edition: "2. The size of penalty is determined by court taking into account property condition of the guilty person ranging from thirty free minima of the income of citizens to fifty thousand free minima of the income of citizens if Articles of this Code do not provide the highest size of penalty";
third to state part in the following edition:
"3. The penalty as additional punishment can be appointed when it is specially provided in the sanction of Article (the sanction of part of Article) of the Special part of this Code.
Additional punishment in the form of penalty can be imposed in case it is not provided in the sanction of Article (the sanction of part of Article) of the Special part of this Code, is exclusive in case of approval by court of the agreement on recognition of guilt in criminal proceedings of rather corruption criminal offenses or criminal offenses connected with corruption and on condition of approval by agreement parties of additional punishment in the form of penalty. The size of penalty is approved by agreement parties and is appointed court in the following limits:
1) from twenty thousand free minima of the income of citizens to hundred twenty thousand free minima of the income of citizens - in case of making of not serious crime;
2) from hundred twenty thousand free minima of the income of citizens to six million free minima of the income of citizens - in case of making of serious crime;
