About some questions of implementation of article 57 of the Constitution of the Republic of Belarus

S. concerning opinion of the Constitutional Court on operation of article 57 of the Constitution and realization of the right of citizens of the Republic of Belarus to replacement of military service alternative on religious beliefs, established the following.
Article 57 of the Constitution provides that protection of the Republic of Belarus is obligation and holy duty of her citizen. The procedure for passing of military service, the basis and condition of release from military service or replacement of its alternative are determined by the law.
Thus, the Fundamental Law does not consider military service as single and unconditional as allows possibility of release from military service or replacement of its alternative.
It means what corresponds to obligation and holy duty of the citizen of the Republic of Belarus on protection of the Homeland on the substance of its right to accomplishment of this obligation and debt in the forms determined by the Fundamental Law including by passing of alternative service.
Moreover, in the Law "About General Conscription and Military Service" it is directly determined that the general conscription provides both appeal on military, and appeal on alternative service, passing of military or alternative service (Article part five 1, Article part three 14).
