About modification of some legal acts of Ukraine concerning enhancement of functions of the National Bank of Ukraine on state regulation of the markets of financial services

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In Article 130 of the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 3-4, 27):

The paragraph of the sixth part one to state 1) in the following edition:

"The property right to the parcels of land of agricultural purpose can be also acquired by banks, the National Bank of Ukraine only according to the procedure of the address of collection on them as regarding pledge. Such parcels of land shall be alienated by banks at the land biddings within two years from the date of acquisition of property right. The National Bank of Ukraine performs alienation of the parcels of land of agricultural purpose acquired in property on account of debt repayment on the credits provided to banks for liquidity maintenance according to the Law of Ukraine "About the National Bank of Ukraine";

Part the seventh to add 2) with the paragraph the second the following content:

"Requirements of this part do not extend to cases of alienation by the National Bank of Ukraine of the parcels of land of agricultural purpose acquired in property on account of debt repayment on the credits provided to banks for liquidity maintenance according to the Law of Ukraine "About the National Bank of Ukraine".

2. In the Law of Ukraine "About the National Bank of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 29, Art. 238 with the following changes):

1) in Article 7 part one:

state Item 26 in the following edition:

"Performs 26) according to the powers determined by the Law of Ukraine "About electronic identification and electronic confidential services", state regulation in spheres of electronic identification and electronic confidential services in bank system of Ukraine and in the markets of non-bank financial services, state regulation and supervision of which activities is exercised by National Bank, by provision of payment services, and also forms certification center for ensuring entering into the Confidential list of data on the banks, other faces performing activities in the markets of financial services, state regulation and supervision of which activities is exercised by National Bank, about operators of payment systems and/or members of payment service providers, technological operators of payment services which intend to provide qualified electronic confidential services";

add Item 34-1 with the words "and the requirements established by the legislation for ensuring availability of financial and accompanying services to persons with disability and other handicapped national groups";

add Item 34-2 with the words "including the requirements established by the legislation for ensuring availability of payment and limited payment services to persons with disability and other handicapped national groups";

add with Item of 41 following contents:

"41) establishes requirements for ensuring availability of the services provided in bank system of Ukraine in the markets of non-bank financial services, state regulation and supervision of activities in which is exercised by National Bank, and also in the payment market, for persons with disability and other handicapped national groups";

2) in Item of 1 part one of Article 15:

in the paragraph the thirty fifth to replace the word of "oversight" with the word of "oversight";

in the paragraph the thirty eighth "economic" to replace the word with the word of "prudential";

The fourth and sixth Article 17 to state 3) to part in the following edition:

"The board of National Bank has the right to form Committee on questions of supervision and regulation of activities of banks, oversight of payment infrastructure and to delegate to it powers on implementation of bank regulation and supervision, supervision of activities of payment service providers (except public authorities, local government bodies) and suppliers of limited payment services, implementation of oversight of payment infrastructure, in particular applications to objects of oversight of the measures of influence determined by the law and also applications to banks, payment service providers (except public authorities, local government bodies), suppliers of limited payment services and other faces which can be object of check of National Bank, corrective actions (sanctions) provided by the law except the measures provided by Items 11 and 12 of part one of article 73 of the Law of Ukraine "About banks and banking activity";

"The board of National Bank has the right to form Committee on questions of supervision and regulation of activities of the markets of non-bank financial services and to delegate to it powers on implementation of state regulation and supervision, currency supervision in these markets, and also applications of the measures of influence determined by the law to participants of the markets of non-bank financial services and the collection companies";

The second Article parts one 61, Item 2 parts one of Article 67 the word of "oversight" to replace 4) in the paragraph with the word of "oversight".

3. In the Law of Ukraine "About banks and banking activity" (Sheets of the Verkhovna Rada of Ukraine, 2001, No. 5-6, of Art. 30 with the following changes):

1) in Article 2:

in part one:

determination of the term "banking group" to state the paragraph of the sixth in the following edition:

"The bank holding company and predostavitel of accompanying services who has the general controller with members of banking group belong to structure of such banking group";

in determination of the term "members of banking group" of the word "auxiliary" shall be replaced with words the companies on provision "predostavitel of covering notes";

in part two of the word "the company on rendering support services" shall be replaced with words "the supplier of accompanying services";

2) in Item 7 parts six, Item of 1 part of the twenty fifth Article 9, of part seven of Article 24 of the word "economic standard rates" in all cases shall be replaced with words "prudential standard rates" in the corresponding case;
