About entering of amendments into the Criminal code of the Republic of Uzbekistan for the purpose of prevention of corruption in the field of sport

In recent years in the country large-scale reforms on promoting of sport, further development of sports and upgrade of sports infrastructure are performed.

At the same time now there is need for entering of the new regulations into legal acts for this sphere directed to the prevention and anti-corruption in sport.

This Law to the Criminal code of the Republic of Uzbekistan makes the additions establishing responsibility for illegal obtaining by participants and organizers of sports competitions of material values or property benefit, and also for bribery of participants and organizers of sports competitions.

This Law will serve enhancement of the national legal system taking into account modern international standards and the best foreign practices, to forming of the uncompromising relation to corruption, ensuring inevitability of responsibility for making of crimes in the field of sport, and also to strengthening of image of the republic on the international scene.

Article 1. "Article 214-1. Illegal obtaining by participants and organizers of sports competitions of material values or property benefit

Obviously illegal obtaining by the athlete, trainer, sports judge or other participants and organizers of sports competitions of material values or property benefit for accomplishment or failure to carry out for the benefit of person of certain action performing bribery who they shall or could make for the purpose of intentional change of results or the course of sports competitions, in the absence of signs of the crimes provided by Articles 210 and 214 of this Code -

it is punished by penalty from fifty up to hundred basic settlement sizes or deprivation of certain right up to three years or restriction of freedom from one to three years or imprisonment from one to three years.

Same actions, committed:

a) repeatedly;

b) in large size;

c) by racketing;

d) by previous concert group of persons, -

are punished by penalty from hundred up to three hundred basic settlement sizes or deprivation of certain right from three to five years or restriction of freedom from three to five years or imprisonment from three to five years.

Same actions, committed:

a) in especially large size;

b) organized group or in its interests, -

are punished by penalty from three hundred up to six hundred basic settlement sizes or imprisonment from five to eight years.

Article 214-2. Bribery of participants and organizers of sports competitions

Obviously illegal provision to the athlete, the trainer, the sports judge or other participants and organizers of sports competitions of material values or property benefit for accomplishment or failure to carry out for the benefit of person of certain action performing bribery who they shall or could make for the purpose of intentional change of results or the course of sports competitions, in the absence of signs of the crimes provided by Articles 211 and 213 of this Code -

it is punished by penalty from fifty up to hundred basic settlement sizes or deprivation of certain right up to three years or restriction of freedom from one to three years or imprisonment from one to three years.

Same actions, committed:

a) repeatedly;

b) in large size;

c) by previous concert group of persons, -

are punished by penalty from hundred up to three hundred basic settlement sizes or deprivation of certain right from three to five years or restriction of freedom from three to five years or imprisonment from three to five years.

Same actions, committed:

a) in especially large size;

b) organized group or in its interests, -

are punished by penalty from three hundred up to six hundred basic settlement sizes or imprisonment from five to eight years.

Person which provided material values or property benefit is exempted from liability if concerning it the racketing of material values or property benefit took place and this person within thirty days after making of criminal acts voluntarily declared the incident, frankly regretted and actively promoted disclosure of crime".

Article 2. To provide to the Prosecutor General's Office, anti-corruption Agency, the Ministry of Justice of the Republic of Uzbekistan and other interested organizations execution, bringing to contractors and explanation among the population of essence and value of this Law.

Article 3. To the Cabinet of Ministers of the Republic of Uzbekistan:

bring decisions of the government into accord with this Law;

provide review and cancellation by republican executive bodies of their regulatory legal acts contradicting this Law.

Article 4. This Law becomes effective from the date of its official publication.
